Finally - NNA acknowledges GLBA doesn't mention notaries ! !

Attached is a link to an article referenced in the latest NNA mailing I received over the weekend. It's interesting and different from previous material sent out about GLBA in that the NNA ACKNOWLEDGES the GLBA does not specifically mention notaries and does not require background checks. According to the article, the requirement comes from "banking regulators with the U.S. Department of the Treasury who — in their interpretation of the legislation's Interagency Guidelines — instructed financial institutions to require that everyone in the mortgage lending process who handles consumers' personal and financial information be background screened — including Notaries".

Why am I Not Surprised. Years ago when I worked for a bank RE: GLBA we had to watch a 30/min video once a year and sign a form stating we would comply with the rules and regs of GLBA and the Feds. When you work for a bank in any capacity trust me they know more about you then your mommy. Notaries in every state (to the best of my knowledge) are screened by the state before they license you.

NNA anything to make a buck!

That being the case there are still companies that are now

saying you must have either theirsor the NNA's BGC or you can't work for them. What can we tell them that might change their minds? They seem tobe quite brainwashed and they won't even accept a BGC from another company. It all goes back to the pocketbook since you have to use someone they are getting a piece of the action from.
Sure doesn't seem faair but then again "fair" doesn't really exsist!

My take on that one Ilona. Just raise your fees when you work for those companies to pay for the Rip-Off . That's just good business and as you say "life is'nt fair" so they should absorb the increased cost of doing business.

Teddog....

I was trying to remember, (not a good thing this early!), but I seem to recall when I 1st applied for my commission, that there was somewhere in the app stating the SOS would do a BGC, but I can't find that now.
I have no issues with a bgc, other than, if the SOS has already done one, WHY is that not good enough?

In Oklahoma, the OSBI conducts a CBGC on all notary public applicants. If you have been convicted of a felony in any state, your application is denied.

Also, how the heck do they think we are able to get E & O insurance. If anyone thinks that the insurance company doesn't do a background check before they issue that policy they have to be nuts.

Good morning Bonnie!

Boy I'll tell you "they'll do anything" for a buck. I really don't care either who checks what. My concern is, who the heck is going to have access to our PRIVATE information. In this day and age you have to be Very carefull just where your information is going and who has that information. What guarantee do we have that our information is secure ? The turn-over that some of these companies have gives me the chills just thinking about it. I'm so carefull now that I look-up a companies phone number and call them before I send them any personal info. This is just my personal opinion.

By the way did you hear "The Russians are coming to Pueblo" thay bought the steel company there.

Probably not. They are Russians and we're the untrustworthy Americans. lol Plus they are bringing "the big bucks" the notaries are just the good ole working stiffs.

Russians? I haven't had time to read the paper and am always gone when the news comes on! I wonder if this will make some improvements at the steel mill? Hmmm.

It is scary who actually has our info! Some of these SS that have our info, how do they screen employees? A lot of SS owners aren't even Notaries, and you KNOW thier schedulers sure aren't! A lot of these I would hesitate to give my dogs info to, much less my own!

Some have internal ones that are much cheaper than NNAs, i.e., Fiserve's is $23 for 3 years. And, you can still recover the cost with your fees as others suggest.

As a Notary Public !!

In order to identify anyone requiring my services, I MUST obtain certain sensitive information. My state statutes MANDATES what information is to be collected and how it is to be kept confident. If you are in compliance with your state statutes, it's a good bet that you are already in compliance with the G-L-B Act. Does your commission state that you are a Notary Public, or Loan Signing Agent?

Gosh Lawrence I sure hope we're all in compliance with our state laws. My bet is we are in compliance. Let's see License is current , have E&O insurance and not (Wanted) in any of the 50 states. LOL How correct you are Lawrence.

My take on this is the same as everyone else. It appears that most if not all states require a background check in order to become a notary. That being the case I don't see any need to pay for extra back ground checks. If a company wants to do a check on me I say let them, but they can do it a their own expense not mine.
