Interesting statement regarding the company that bonded me

I was talking to my niece today (who is also an insurance agent for the agency that I got my bond from) about the GLBA and CBC. She informed me that when I applied for my bond, prior to getting my commission, the bonding company ran a CBC on me before I could be bonded. Also, my state does a CBC prior to issuing a commission.

Florida requires a person to be bonded prior to receiving their commission. Though the notary manual and statutes don't specifically state that a background check is performed, the SOS has responded to some notaries, myself included, stating that the state does a background check prior to issuing the commission. However, the SOS office did not elaborate on what type or how detailed of a background check was performed, but I'm sure it isn't as intense the checks done for licensing, such as a RE broker or Mtg broker's license, which is a full, national FBI check.

MI does not do a backround check, I don't know why

people in Michigan think that they do. The wording in the Public Act is that they MAY do a background check. The state does not routinely do this. They left the wording loose in the event they start to do it. Then they will increase the fee to become a notary.

My kids' school did a check on me before I could go on field trips.

Hey, Julie =)

Years ago I got involved as a 4-H Community Leader - THAT was the most in-depth background INVESTIGATION I've ever heard of. They sent 5-page questionnaires to my neighbors, and the relatives and friends I'd been asked to provide, on TOP of all the 'usual' BG checks AND bonding. All primarily because of the contact with children.

I wonder - do they do this to teachers?

Teachers

Renee, my husband works for a school district. When he was hired the union did not permit background checks. Then some law changed and if you were hired before a certain date, the employee was grandfathered and only new hires after a certain date got L.E.I.N. checks. But I think the district can go back and check those grandfathered people now if they want to.

My brother, a notary, and I were arguing over this very topic. He called one day and I called two weeks later and they do not check. Like I said, they MAY check. I had to my commission expired after the new law and they didn't check.

Who told you they did check?

The Office of the Great Seal told me they DO check when we "apply" or "renew".

Like I said earlier in my post to Carole, the State of Michigan doesn't believe
what we "certify" to --- they do check. They can't just believe people --- that's
why the laws changed for Notaries (you can no longer have a criminal background
to become a Notary in Michigan).

Try calling the Office of the Great Seal again --- try to bypass the ones that answer
the phones.... talk to Rose.

DNA--->Sample

I am waiting for them to require DNA samples from us to be included with every closing. We will probably have to lick or swab something!


As far as I know, on the smaller independent mortgage bankers, there is no requirement for them to have criminal background checks and they may get more confidential datas than the notaries.

I've been saying that for years, Dave. Smile

The sterlized pack with latex gloves, tweezers to remove a piece of hair and one test tube per borrower for the sample. This is why perfect title work will be essential, so ensure their are enough test tubes for vested owners.

I'm going to submit this proposal to the NNA, it is surely to become part of the model notary act. The NNA will then sell these kits to the title companies/lenders and we will have to take a day long seminar for $300 on how to address issues such as the bald borrower and what other dna will be acceptable. Only those that are approved by the NNA will be allowed to do closings.

I remember when I was in high school, filling out job applications and coming across the question "have you ever been bonded", being quite naive at that time, I always marked the no box, thinking it was a bad thing if you had. I believe I thought this because it usually was asked right after the guestion "have you ever been arrested"
A few years after that, as a part time job I cleaned houses. One lady asked me if I had ever been bonded and I said very strongly, NO....NEVER. She looked at me puzzled and asked if I had thought about it for cleaning houses, that it would probably help me in obtaining more work. I was really confused thinking, why would I want to get bonded?
This is when I found out, being bonded was a good thing.

Lisa, that is TOO funny! But it does make sense.. apps always ask if you've been bonded after the question "ever been arrested?"

Will they be sending you a copy of the CBC? Did you ask for a copy?

I think that MI does a CBC on us too. I don't know how long you have been
a Notary but, years ago there wasn't anything written in the PA / MCL's
about having a criminal background (there is now) -- years ago incarcerated
people were becoming Notaries, and causing problems for the correctional
facilities.

Since a few of the Notaries feel that MI doesn't do a CBC through LIEN, I ask
this..... Do you really think that the State of Michigan believes what is written
on the Notary applications? (Especially where it states - "I hereby certify....
; not currently incarcerated in a correctional facility or have served time during
the immediate past ten years for a felony or misdemeanor offense in any state"Wink.
... I'm sure their will be some Notaries that will still say that MI doesn't do a CBC.
