Late or no payment for services

This has really got me up in arms. Settlement Companys or Notary Signing Services that either are late paying our bill ( over 30 days) or force you to chase them until they pay. They are using MY MONEY. I as a professional always give 110% to make sure the closing go smoothly and everyone (Borrower, Lender an Settlement Company) are happy and satisfied with my service. I am prompt and complete the closing (including retuning docs) in the fastest possible manner. I EXPECT the same from the people I am doing the job for. Now that this is off my chest, I am wondering, if we are listed , at least included in the settlement costs on the HUD and we are not paid, does it make this an illegal transaction or questionable at least and if we contacted the lender and or the the courthouse where the mortgage is filed would that make a difference?

Frank, unless your name is on the hud... I don't think you

have much of a case. The title company will have paid the SS beyond that I don't think they bare any responsibility...
That being said many have had luck contacting the TC regarding SS's that don't pay... Not sure if I would do this, but I would have no problem telling the SS that isn't paying that I will... ;-)

I have not been listed personally. It will say Notary fees and that's it. I am in the same position right now with Accusigning out of chandler arizona. I am fighting a claim from July.
This is so unprofessional. I should say I have a collection agency doing it but I still have not heard from them. They have even been turned into the better business bureau and they still are not motivated to pay me. They probably make a ton of money a year from notaries not following up on money they are owed. I am not one of them. The 75.00 isn't the point now, it's the principle. Michele Alcala (Got-Notary)

Title won't pay you, but calling Title can provide the motivation to an SS to pay you. At the very least, it gives Title a heads up that they are dealing with a pondscum SS. You will never hear from that SS again, but then--why would you care?

Lee, don't get me wrong... I could care less about the

non-paying "pondscum" SS that doesn't pay. Don't want them calling me again anyway...
The only reason I would be hesitant to actually call title regarding payment is that I don't want to be seen as a PITA by the TC. I want them to see working with me as smooth sailing no hassle get the job done. ETC...
My problem is with the SS not the TC and while I would threaten to call the TC, I don't think I ever really would...
Not saying at all that it's wrong to do it... Just giving another viewpoint regarding it...

Depending on how you present yourself I don't think you would be regarded as a PITA. I would think that a reputable TC would welcome knowing that they are dealing with a flakey SS. Maybe I'm wrong but that's how I would pursue it.

Michele. I realize we will get burnt sometimes , that is part of being in business. What I don't expect is larger reputable companys, who have been fair in the past about paying, to become accounting driven. By the way raise your price and some of those fly by night companies go away.

I wonder...

I wonder if showing a fee on the borrowers statement for notary services and then not paying the notary could be construed as a RESPA violation?

Even the possibility would get some action, even if you couldn't make it stick when push comes to shove.

I wonder if having a website that listed everyone's No pays until the bill was paid would help. You say listed as a NO PAY and your name stays there until it's paid.

Only other thing I can think of. States passing legislation requiring all SS and companies to have an (escrow) account of sorts to pay Notaries. No escrow account for fees - no license. With a three strikes , you're out law.

Makes you laugh about a fancey , dancey law requiring us to have even further clearance. HA!
