The lender just called me and wants me to send a Jurat for the Borrower Contingency/Settlement Acknowledgement and Identification Affidavit, since I did not notarize either.
I left a phone message that the ID Affidavit stated:
"I/We XXX Title and Excor Corp, being first duly sworn, deposes and say that I/We, acting as Closing Agent for the loan described above, have personally obtained and observed photographid identification or acceptable equivalent of the Borrower(s), and do hereby certify to the following: blah blah id information
closing agent signature and date then notary acknowledgement
The second documents states : I the Closing Agent, certify this Acknowledgement was delivered and explained to the Borrower(s) on the Settlement Date. Closing Agent's Signature Settlement Date
Subscribed and sworn to (or affirmed)before me this......
Neither of these documents can be notorized by me.... Do you think they will understand?

Well, they don't have a choice now do they. Here in Ca can't notarize own sig. When this has come up for me, it has never been an issue.. I just explain to them what I can and can't do. End of story. Never a problem.

Whenever this has come up for me, either the same as yours or the "extra" ack for just in case, I line thru the notarial area and write "NOT LEGAL FOR ME TO DO THIS!" I've never heard anything back about it that way.

I guess it worked out.
The LO called me and treathened non payment because the loan would not fund without those documents, and it would have to be redone. I was the only notary who would not notorize those documents- apparently I did not understand them. Then she had her supervisor call me.
I told him the same thing. I could not notorize my signature stating I had verified the ID information, and I could not notarize the signature of the settlement agent when the loan settled on the 6th and the signing took place on the 1st. Let's see if I ever get paid. Kathi
