Request 4 Illegal Act

TC advises me that ack from a 2/06 closing is incorrect. TC wants me to complete correct ack and return. Correct ack requires a witness. I advise TC that I will return "free of charge" to have the correct ack executed. TC then requests that I back date. I advise TC that if I complete the ack, it will have the current date. Still waiting for TC to agree to a legal ack. It just amazes me that I offer to correct my oversight and they STILL want me to jeopardize MY commission!

Yes, assignment was completed on 2/27/06.

Why would this come up at such a late date??

There's no way you can comply with their request. If they don't understand that what they're asking you to do is illegal, you might consider reporting them to your SOS, as well as to the SOS of whatever state their located in.

Well, it apparently wasn't anything that held up the loan or caused a deed not to record. Someone missed something when you returned the paperwork and it was caught on an audit and now someone is trying to cover their 6 . The time for them to have you correct it was the day they reviewed the paperwork, not 9 months later .

The audit of a loan by the lender is not reason to change a certificate. Recognize it for what it is and....ignore it.

Or? let's just all roll over and do anything/everything the lender says or requires. C'mon...don't you see this for what it is???

1) A good reason to have E&O.

2) If you do the illegal act, your E&O would not apply.

3) Any questions on what to do, call your state official and ask!

You are right in not to back date... That's your hiney. If you want to have a Merry Christmas and 'Tis the season without worry, don't do this.
