To Charge OR NOT To Charge...


Sitiation: I performed a signing on October 25 for a TC (for a borrower whom I am acquainted with). As of yet, I have not been paid for the signing. I inquired to the borrower (since I know him) if escrow had closed and he proceeded to tell me that the loan amount was not approved and that they wanted to fund for a lesser amount. He also mentioned that they would need me to perform the signing again for the NEW loan amount...

Question: Since I have not been paid for the first signing, do I re-invoice for the FIRST signing and issue a new invoice for the NEW signing... OR... since the first loan didn't go through, am I only to receive payment for the one signing that does go through??? (Did I lose anyone here?!)

PLEASE HELP! I'm stumped...

I'd say you have two, or one and a half payments coming if you get the second job.

If you don't get the job a second time, you should be paid a full fee on the first...unless you agreed not to get full fee for a loan that doesn't fund.

I would say bill for both

It was not your negligence that prevented funding.
As far as I can tell, you performed as agreed, and deserve to be paid.
Unless the TC has a no-pay or partial-pay policy for non-funded loans...
It's always a good idea to know how they pay in the event of a glitch.

Good point. But does it make a difference if the borrower referred me to do the signing? I never actually inquired about their payment policies, since they didn't actually do the hiring (they just agreed to let me do it). But when I submitted the invoice to the TC, they politely thanked me and said they'd keep my contact info for future signings.

They just "agreed" to let you do it? Did the TC call you to do the signing or did the borrower hire you? I don't quite understand what you mean.

IMHO, ultimately the borrower will have to pay for your services if the second loan closes. If he has no problem with paying for the first signing, then it is his call. If he expects you not to charge for the first signing, then it is your call on what you want to do and how far you need to go. The TC most likely will not argue with you and the borrower on your combined decision…
