I don't know if they are the same or not. But i've had a real bad experience with two Alliance title offices. One of them told me the loan was canceled anbd that I should go after the mortgage co. (they did hire me) and the other office flat out lied to me and said they never hired me. And then they said "oh the docs are being re drawn" we'll call you, and then i reminded her that this was over one month ago and that the customer had canceled twice ...oops!

Poor Business Management and more like the company has become FRAUD. They just wont paid anyone and would rather lie about it. If a company calls you and you are not sign up with them yet, do the paper work first and make sure you get the names, date, times and company name when you take the assignment. Also get the Lender and Title company names along with the borrowers. that way you have something to bill with, and trace who is really lying
Transconitnel Title is in FL and is not connected with Alliance Title. Who ever calls and gives the assignement are responsible to pay you either the loan closes or not.

There are companies not paying if the borrower refuses or after 3 days they recind. Make it a policy that if the borrower refuses to sign after you get there, you still get paid for trip and printing, if the closes cancells in less than 90 minutes and you printed already, make sure you bill them.

There are signing companies who will refuses to pay when borrower refuses to sign, you did all the work still either they sign or not, you took the time to print, paper, ink and drove there.
INform all signing and title companies of your 4 main policies when ready to take the assignments. Make sure they understand it. Alwasys get names of the person adn company name.
Policy 1- Is is a signle closing, (give fee) a double closing (give fee) or Heloc (give fee)
Policy 2- Cancellations in less the 90 minutes, printing is done, charge will still be charged
Policy 3- Refusal at table, full fee will be charged either it closes or not.
Policy 4- 15-30 days when payment is due.

My experience with TCs is, if the file does not fund no one gets paid. My main point would be what leverage could a NSA have in attempting to collect a signing fee from a TC when the loan does not fund? Most TCs know and understand the number of NSAs in any given area they service may be large, and play that card when a NSA demands fees on a canceled file. In some cases TCs are asking for NSAs to sign an agreement stating if the file does not fund no payment would be made for the signing. If the NSA does not agree, they will find someone else…

This is just an observation made by me and by no means am I trying to paint an unfavorable picture for TCs.

Someone (I think it was in this forum) made an interesting point about this. If your getting paid is contingent on the loan funding, then you have an interest in the transaction. In many (if not all) states, notaries are not allowed to notarize documents when they have an interest in the transaction. I guess you could make the argument to them that what they're asking you to agree to is illegal. I'm not sure whether they'll buy it, but it's one approach you can take...

regardless as to whether or not the loan funds. If my payment is contingent on funding of the loan, I now have an interest in the transaction... and that cannot happen.
SS's don't care... you can tell them a million times and they'll say "But you signed our Independent Contractors Agreement that says..."
TC's, on the other hand, are generally more interested in compliance with the law.

Not all of the ICAs I've seen so far address what they will do if the loan doesn't fund. If the ICA says anything like "no payment if loan rescinds, cancels, or otherwise does not fund", I won't sign the agreement. So far I've only had one or two like that, and I took a pass on signing up with them. For those that are silent on the matter, I expect to get paid in full for work performed.

NY's notary law says: "In New York the courts have held an acknowledgment taken by a person financially or beneficially interested in a party to conveyance or instrument of which it is a part to be a nullity; and that the acknowledgment of an assignment of a mortgage before one of the assignees is a nullity; and that an acknowledgment by one of the incorporators of the other incorporators who signed a certificate was of no legal effect."

I guess if I offered to call the county clerk and discuss whether that mortgage I notarized should be nullified because I was unknowingly made an interested party, it might get them to re-think their attitude about payment for services rendered...

I fully agree with the premise of compensation for services rendered. However, the business reality is that if I demand payment from a TC for a non-funded loan, I may eventually get my payment. But I will probably not receive any additional work from them. Considering the fact of very low percentage of non-funded loans (in the low single digits), am I going to destroy my relationship with a TC for a single payment?

The large number of NSAs in a particular area gives TCs the ability to find notaries who are in agreement with their terms. If I was the only NSA within a specific area, I may be able to drive TCs to accept my terms, but that is not my situation …

Didn't someone just tie SOX to Alliance Title ?

Someone on this forum just asked if SOX, (bad reputation), and Alliance Title, (also bad?), were the same as they had been contacted by both for the same closing.
It sounds like they just might be?

Yesterday someone got contacted by SOX and she turned it down. 5 minutes later someone called again claiming to be Alliance Title from the same #. Basically SOX was pulling a fast one and she caught on. Therefore they got caught in the act and she told them that she knew they were really from SOX and turned down the job.

I did a signing with Transcontinental Title & Escrow, Irvine, CA. I received $75.00 for a trip fee / Docs Incorrect Rate on Note, and then $150.00 for a REFI. with same borrower. PAID within 2 weeks! A great company and staff communication!
