Collections. Chain of Email. Opinions please:
Good Morning Everyone. Just thought I'd share my recent conflict with an attorney who is VERY late on making payment. Some of the invoices are from JULY. Here is the chain of email that was sent back and forth. All of these took place on 10/12. I am changing the name of the attorney to "Joe Schmo" just for posting purposes.
Note that I have only edited the name of the attorney and the names of a few title companies that he listed in his email. I have not changed anything else, all of his word are exactly as i received them.
------FROM ME TO Joe Schmo:
Mr. Schmo, I have attempted on multiple ocassions (with no responce) to contact you via fax, email, and phone in regards to your unpaid balance. If your payment of $325.00 is not received on or before 10/19/06 I will be forced to notify all of the following, in this order: 1) 10/20 Notify the Better Business Bureau of non-payment for services rendered. 2) 10/23 Notify the Lender/Title Company of non-payment. 3) 10/24 Notify the Notary Public Section of the State of New Jersey of the failure to make payment to a sworn public official. 4) 10/25 Notify the New Jersey Dept. of Banking and Insurance and notify them of the non-payment. Please remit your payment immediately.

Mr. Anthony your check will be fowarded on next thursday which is the day i get paid. the firm has gone through cash flow issues. If that is not satisfactory i am sorry. now with regard toyour email if you want to "go there" i will see to it that no attorney , no title company, no lender utilizes your services now and in the future. I will in addition file a defamation suit against you and whether i win or lose i will see to it that you are in court a very long time. If you want to play those games trust me i will bite back... however what you are threatning will not accomplish anything, what i will do will effect you. Let me know if payment received is acceptable by next friday or sat which is when you should get your check. if not so be it. who do you think you are.?

oh yea one other thing, i know you have tried to solicit business from the title companies "ABC" and "XYZ" (names edited) after we ceased doing business with you. You are running a service for attorneys and title companies.. i wonder what they would think if they all knew that you were soliciting the lenders they are doing business with.? my contacts have verified that and if you want to go the route you are planning let it be known that was another mistake you made. joe schmo.

Mr. Schmo, All I want is for you to pay for the services that were rendered. I believe 30 days is more than enough time for a respectable attorney to make good on a debt. Your cash flow issues are a) not my problem and b) none of my business. I just want payment for the work performed. Payment by Saturday, 10/21 is acceptable.

all i can tell you is that you would not dare threaten a major title company if they were late in payment. i honestly could care less what you thinkis your problem or not.. if someone cannot pay something they cannot pay... however like i said you will be paid.

Note to everyone: FYI: I have not solicited ABC or XYZ title. I have worked for both of them (as have most of you), they found me on one of the directories. Probably NotRot.

I cannot even begin to state how this pi$$ed me off. Just who does Mr. Yahoo think he is? If he were in the same state I would take his butt before the Bar for the threats upon your financial future. I would talk to so many people associated with my job and the state that everyone from border to border would know about the mouthy attorney with the mafia attitude. Although I'm a peaceful person who tries to follow positive flow I WOULD BECOME HIS WORST NIGHTMARE. The very idea of veiled threats starts my motor hummin! You don't need to be doing business with someone so dumb, take him to small claims and erase him from you cell phone.

I once received a ridiculous email response from the head of a law firm that I had contracted to represent me in another matter. This particular law firm has offices in Newport Beach Ca, San Fran, Minneapolis, Cincinnati and Boston. On his website he listed his affiliation with many organizations - International Society of Barristers, etc, etc. I forwarded his letter via email or fax to every organization he was a member of. I ccomplained and forwarded his letter to the CA Bar
Although he was in Newport Beach CA, I went to his office in Boston and passed out copies of his email to anyone that would take one. While I was there, I told staffers that I was on to Cincinnat next on my "World Tour".
All I really wanted was for him acknowledge that his reponse to me was wrong and to apologize. However - when he finally had the balls to call me to apologize - I literally made him say "UNCLE". It was one of the best days of my life!! GO GET 'EM!!

I would wait until the 21st and if payment isn't received I would forward all emails to any party's that maybe of interest. If payment is received I would still pass out the emails to everyone.
This A-hole is a bully and thinks he can get away with it. Teach him a lesson in humility and how to treat his vendors. I think you should tell him to stick it!.....after you get your money.

but I am going to maintain my professionalism, and not stupe to his childish level.
I am going to sit tight and wait for the check. Should I hold my breathe? lol.

Those threats are unacceptable, time to contact his Bar
Association and explore complaints through them. I think a complaint hears through the professional standards committee might get his attention.

JB, I have experience with reporting an attorney to the bar. When I went to his office to collect, he called the police and took a restraining order out on me and said he feared for his life. He was 6'4 and I am 5'0". I got the restraining ordered dropped, the judge said it was ridiculous. Then he took me to court for deframation, libel and slander and I won. He got disbarred, filed bankruptcy, lost his home and could not even get a job as a law clerk. He messed with the wrong person. I filed with the Bankruptcy court for my money which I never got, but it got me on a mailing list of creditors and I got dates when he would be in court and I showed up with all the other creditors. I have a judgement for $3,000.

What you want to bet that the one that JB is dealing with, as well as the one Margaret had to deal with both had drug problems? I think so. This shows a very high risk behavior for a lawyer. The money problems have meant cocaine or some type of drug where I have seen this before.

Bingo!!!There was more to my story, but it is long. I have a friend who is a private investigator and she helped me. She's a beautiful buxom blonde and she went undercover, so to speak. She got so much on him that he did not even fight or attend the Florida Bar hearing, he knew is was a goner. I use a PO box, not in the town I live in for my billing address, so he did not even know where I lived. He still does not know that the PI was working with the police.

If there's one thing I know, Margaret, it's spotting dysfunctional, out of control personalities. They are very hard to cope with. Steer clear whenever the first encounter seems off-balance--good or bad. Sociopaths are very good at gleaning the very thing a person wants in life and playing to it. Sometimes they ring "hollow" but other times they are able to cover their "act" quite nicely . . . until it is too late.

Hi Jersey, I hope you don't mind....I just had a payment issue with a law office in New York (and I will absolutely name them: Marc H. Sanders, Esq., Moberg & Associates, P.L.L.C. 333 Earle Ovington Boulevard, Suite 1020, Uniondale, NY 11553) and used your tactics. So far, nothing.
The only comment they wrote back was "It is clearly a condition that we do not pay the closers if the loan does not fund."
I wrote back and said "yes, but this is the first I have heard that a loan did not fund. Because checks were issued on both closings, I am not sure I understand your comment.
A) Sale (1st) Closing: Title Source advised that check had been issued to incorrect address and was to be reissued to correct address. Have not yet received.
B) Refi closing: Moberg & Associates sent a check to my associate although I was to have received payment based on prior arrangements/invoice/proper procedures. Check was not forwarded to me/cashed because it was sent in her name and in the name of someone else. With this said, there is nothing “clearly” about your comments.
Will see if the follow-up does anything.
