I wrote a letter to the NNA regarding their new policy regarding background checks when they first started this push and got a response today.

Crystal Lee Mangona RE: Background Checks I have submitted a letter to the CA Attorney General that asks for a ruling regarding the Live-Scan Fingerprinting and Background Check adminstered through both the California Department of Justice and the FBI. It would seem that this by far exceeds the reqirements as set forth by Gramm-Leach-Bliley. Perahps it is you that should review the law and correct your policy regarding California Notaries being forced into purchasing services that they are already required by California law to have in place to recieve a commission. It is my own, extremely humble opinion Becca ...
that you might possibly have caused me to be in sudden need of Windex for the monitor as well as a change of clothing ... I am not certain, have yet to research, but highly suspect it might be true.

I downloaded this some time ago
But until the SOS or the Department of Justice gives a legal ruling, that pdf certificate is completely devoid of facts and useless. I agree with what it says, but I have no standing nor does the author to make that claim.

It may be NNA policy but it is NOT a federal law. Ask them to refer you to the Fereral law that mandates background checks. it is not the GBL.

Refer to Msg #148916 re Federal Law - there is no law, it's
the Federal regulators over the lending industry that are requesting this.
