who think our BC only includes a criminal search only for this State I got this paragraph from the Department of Justice site. It seems that the search is linked also to the FBI. I sent a e-mail to the SOS to get a ruling on this issue and will post when I recieve it.


There also is a criminal history processing fee collected by the California Department of Justice and Federal Bureau of Investigation for the background checks. While often paid by the agency requesting criminal history reviews, some applicants may have to pay this fee so check with your requesting agency.

I'm reprinting some of his post. It about says it all...

GLB reqires a procedure for keeping private information secure and charges the various agencies responsible for financial information to establish guidelines and then integrate the guidelines to come up with a recommentiation, as far as I know the FTC is the only agency with at rule. The NNA mis-information machine is at it again. ***(his opinion of course)***
My SOS states that CA's background check meets and exceeds GLB. I have requested the Ca attorney general comment and I have not received the information back yet. it takes the Attorney General a long time to make comments.

in MY opinion, the NNA is trying to earn an extra buck and monopolize this background check, just like they flooded CA with promises of riches and I think they are pixxed that Harry is putting something together.
I have had discussions with several of my companies. The basic response is 'if we want a BC, we'll ask you for one'.
I am not rushing over to pay the NNA for anything but a listing. I do get calls from companies that find me there. Some will meet my fee, others won't, however the NNA has a huge presence and I will take advantage of that.
I still can't believe they wrote Harry and threatened any of our community with a lawsuit for libel. I wonder if they sent the same correspondence to EVERY notary website forum, including gmn! My guess (opinion) NO.

Great comments Charm! I am not surprised that the NNA

would take the bullying approach with Harry and Notary Rotary because Harry and Not Rot are not only disseminating well-deserved dissent ion but Harry had the temerity to come up with an alternative solution. I am sure that whizzes the NNA off to no end! I see the attorney gambit as strictly a bully move to shut up the negative comments. A well placed threat against a small business by a business with deep pockets definitely serves to increase the pucker factor, I know I've been there. Some fights are not worth the battle, some fights I prefer to choose the battleground but under any circumstance I don't like to have a disadvantage. Like any good business many Harry has to make a choice as to whether or not the battle is worth the allocation of resources. In our litigious society even to defend your self successfully takes a lot of money upfront, no lawyers line up for pro-bono work unless there is an alternative return on investment. The NNA knows this. The best way to stop the disinformation machine is to take the truth wherever you can, other forums, letters to the editor and one of the best places is with your elected officials. I believe that the NNA is trying an end run to cut off their losses and bolster sagging membership and they are hoping that notaries aren't smart enough to counter.

Very well said Charles and Charm

and I couldn't agree more. Harry has my support and even if he can't come up with an alternative I will support this site 100%. This society of blood suckers lives and breathes the "easy road" i.e. "sue the he$$ out of anyone that looks at you cross eyed". As an attorney once told me "you can sue anyone for anything, doesn't have to have a basis, just need the hungry attorney" and I see that daily. It's never about an issue but ALWAYS about the dollar. Sorta like not all Muslims are terrorists but ALL terrorists are Muslims. In the 70's I had a co-worker sue me for a million dollars...A MILLION! My lawyer roared but he wasn't laughing when he couldn't get it thrown out. After they took her deposition it was determined she brought suit against me because I didn't invite her to lunch. Case dismissed. However it does give validity to what I was told, ya can sue anyone for anything if the attorney is hungry enough.

Brings to my mind the fable about the wolf & the knife ... thumbnail version: hunter freezes layers of blood onto knife, buries knife point-up in the snow. Wolf smells blood, begins lapping it off the knife, never notices when his tongue is sliced, continues to lick the blade until he's bled HIMSELF to death.

I had to pay the fee my understanding told in the notary class two submissions two different background checks total cost $53.00 $20.00 was for the city hall that done the live roll scanning.

You got screwed by whoever gave you the class

You already did live-scan through the Department of Justice and the FBI if you are a commissioned CA notary. See below from the Attorney Generals Website

The class didn't give me anything

You are still trying to get comfirmation I got mine done and it came from our Gov with my test score. I'm good this was done recently how did I get screwed by the DOJ my commission expires July 2, 2010

Travelling2u...the confirmation is with the CA SOS

This does not pertain to CA notaries. We paid for a live-scan background check with DOJ at the time we applied for our commission.....check with the California Secretary of State and you will see for yourself that you got screwed. BTW...the Gov does not commission you the Secretary of State does....and the background check is requested by them....again not the Gov.

I think there was new laws came into play...

I wasn't a notary so I didn't get screwed it was the requirement when I got started. Hey if you don't have to pay great!!

Difference in opinion is not fighting unless one person gets angry when they are not perceived as perfectly correct.

Actually a background check is and was always a req for CA

At least for the past 6 years that I have been commissioned. I didn't realize you thought it was a fight...we are here to help eachother (at least most of us) so sorry if I pi&%ed you off...my bad. I do know what you mean though because I see alot of "bad attitude" on this site by the same people all the time so you just have to overlook it and not take it personal...but I certainly don't mean to be one of those people.

No I didn't get mad or thought you were mean...

I was just sharing what I had to do to become a notary the steps they required. With all the fraud and changes just this year alone. Not sure if the notaries will have to file the newcomers like me had to. The SOS spelled it all out with the fees and the name of the scan how much it will cost and the time I had to get it done.

I have so much to learn and want to learn how I want to operate in this business. The last two weeks reading how people are not being paid and all the head games becomes very frustrating.

Its all good Rebecca this is a great place to learn and you are not mean I didn't think that deep ;-)
