Illegal Closers

I am in Maryland. I was just wondering if you closers in other states feel the stress of competing with people who are doing closings without having met the state requirements?

The vast majority of states only require a notary commission. I know you have the TPL requirement in MD, and there have been many posts about companies using non-licensed people. Just as I would if it were a notary doing illegal acts here, I hope you will turn them in whenever you find them.

In California, all notaries are commissioned via the
Secretary of State. Formal notarial training, a
background check and bonding is also mandated.

However, the title such as "loan signing agent" or "closer"
is not recognized by the state and therefore, there are
no state requirements or training for this activity.

Question:

Unless you are privy to inside information,
How would you know if someone is doing closings in Maryland,
without meeting state requirements?

And if they are, they should be immediately reported to
the appropriate regulatory agency (or agencies).

TPL License is required in Indiana

I know of two people who did not get the TPL and they are still doing signings here. I have reveiwed documents at the County Recorders office with their signatures, dated after the new law went into effect. (Indiana TPL requirement took effect 7/1/06)

Due to the illegal activities of these people,
(and once reported to the proper authorities)
how would this affect the mortgage documents?

Would they need to be re-drawn etc. . .?

What state requirements? NC has none other than the Notary requirements.
