It goes without saying, but just a reminder...

Was with a friend looking over a loan file of an extremely abusive loan today (with a loan broker, not as a notary) this one's headed for a lawyer...Among other things there was a POA allegedly notarized by the broker's in house notary.... but the borrowers said they never saw the notary, the loan officer brought the journal to sign and the docs were not stamped in front of them.

The notaries an idiot, but she's not the crook, the loan officer is... but she broke the law, and it's gonna get messy all over her before it's done.

My guess is the LO didn't ask the notary to borrow her journal "so I can rip these suckers off"... he probably found all sorts of ways to paint this black situation several shades of grey.

Anyway, we all know it, even the newbies (at least in CA thanks to our 6 hours of ever so thorough training)... if your boss wants to borrow your stamp and/or journal the answer isn't no, it's HELL NO, and it's a misdemeanor to ask and don't ask again.... and if you feel your job is threatened, wake up and smell the coffee: 1) you can lose a couple years' salary or more when that goes south. 2) he can't fire you for refusing to participate in a fraud... it wouldn't go down too smooth with the labor commission.

Just some thoughts... poor notary, but the right thing to do is help the borrowers recover the several grand they were overcharged... and whoever falls in the process... c'est la vie.

I carry my notary briefcase with me when I'm out (not locked in the car/trunk). When not in use, it's locked in a cabinet at home. Isn't CA law say that the seal & journal must be kept in a safe/lock?

I thought it just stated the seal and journal must be kept locked up where only the notary had access to. That's a good question. My bag has a individual lock and at home I lock my journal and seal in my file cabinet. Will double check that.
