Non Payment - Class Action Lawsuit - AltAir
Has any thought of a class action lawsuit for these companies like Altair Signing Services which don't pay us? What are you thoughts on this?

The only one's who get anything out of a class action suit are the attorneys. The plaintiffs usually end up with pennies from the settlement, if anything at all. And that is IF the verdict is in favor of the plaintiffs. If the verdict comes down in favor of the defense, the Plaintiffs must then pay the Defendant's litigation costs, which, in a class action, can be very steep. You must consider all the pros and cons before jumping in to something like this.

The only way to go is Small Claims court. You don't use an attorney in SC. You can have a class action suit in SC without an attorney. Just get all the notaries together that have been stiffed by the company and all together file your cases. In my opinion this would be good as it would add strength to the case. Don't forget to add late fees and interest of 10%.

Stick to being a notary and forget the legal advice!. You cannot do a class action lawsuit in small claims court!

Better idea. Print about 25 copies of your invoice showing the amounts owed. Behind each invoice pup a Black piece of paper. Fax these 50 pages everytime you have some free time and at night before going to bed. Bet they will pay you shortly. Black pagescan really kill a toner cartridge!

Why would you ever want to initiate a class action suit? They are laborious and take forever to conclude. Representatives need to be certified by the court as capable of representing members of the class. All settlement proposals need to be approved by the court. You are better off initiating and individual suit....and yes you will need to spend a few bucks to do it...nothing in the business world is free...such is the cost of doing business
