Not paid the agreed upon fee

Hi, I am in Calif and have accepted signings from a signing service. He pays well but not in the grand scheme of things. It seems every other payment is 25-35% less than he agreed to. the last set of payments was the last straw....One payment was significantly less. I let one slide as he said the company had not paid him the whole amount... but I look at it as that is his company's problem not mine.

My questions are, have any of you experienced this?
and what do you suggest or have done?

and I will not be accepting assignments from him anymore....

Did you get a confirmation from him? Always make sure you have a confirmation from the ss. Make sure it states the agreed upon fee. If it is not right, call and tell them that you need a corrected confirmation with the fee before you will go to the assignment.

Then, if you don't get the right fee, you have it in writing and can take further action on that basis.

this is a business you are running! If it happened a second time, I would not accept anymore work from the SS. Again this is a business for you I assume and to accept less on your part and for him to pay less then stated is unprofessional on both parts.
It would appear that at some point in time the business relationship somehow crossed over into a casual territory and both you and SS do whatever. Your business must have rules and regulations as does the SS, you either need to attempt to clear this up and MOVE TO A MOVE PROFESSIONAL LEVEL or not work for the ss again. Don't share the name please, not one I want to do business with. GOOD LUCK TO YOU!

yes, I agree it is a business, but he usually pays very well. . . and I allowed the first one to slide as he was giving me very good business and being that I have always been self-employed, sometimes I see it as the cost of doing business.... but he def crossed the line w/ the last set of checks.

My question that I had wanted feedback on was has this happened to you and if yes, what choices did you make?

No it has not happened to me and if it did I would correct it the first time so it didn't occur again. I understand your point of being self-employed and he sent you a lot of work, maybe this is his hook to lure you in, this is not fair business. I would have a serious talk with him, if he thinks he's going to lose you perhaps he will make right what he has wronged......

You are right - it is not your problem that the title company didn't pay him the agreed fee.
You had a "contract" with him for a certain fee. He should pay you the agreed on fee whether he gets paid or not.

What I would do is to send another invoice with the balance due reflected. Show payment received and balance owed. Keep all communications professional. After what you feel in an appropriate time send a letter of collection. If you need one to get you started email me and I will send you one that I have.
If you still aren't getting the money owed you then you have to consider your options and what further action you will take.
