Response from Nations Direct
Since many of you view the list in threaded format and probably wouldn't see the reply in the thread about Nations Direct that is a few pages back, here is the a copy of the contents (in its entirety) of the response from Heather Walters of Nations Direct:
--------------------------------
It is not a requirement - and you can be certified through a number of agencies/seminars (all are accepted) we are merely sending the email out to update our records to whom is certified or not. Again, it is not a requirement merely a preference we used the NNA as they are more commonly known than others. We will be sending out another blast email to our signing agents clarifying this. Thank You Signing Agent Division Heather A. Walters 160 S. Old Springs Rd. Thanks Paul. Seems like this is the kind of action that we all need to be taking. Challenge anyone that is trying to force a decision on you.

I received a call from the Governor's office today...
in response to a message I left regarding the GLB Act, the NNA and Nations Direct. According to their legal dept., no further background check should be required, as the one performed by the State of Florida is comprehensive. They further stated that Notaries Public in the State of Florida are privvy to sensitive financial information during the normal course of Notarial duties, and have been prior to and since the GLB Act was passed into law 11/99.
They further stated that they have been innundated with emails and telephone calls with regard to the GLB Act and the apparent "strong-arm tactics" being used by the NNA to scare Title Companies and Lenders into using "only NNA Certified Notary Signing Agents". Frankly, they are quite upset in Tallahassee. Evidently, the State of Florida does not like it when a private, for-profit Corporation in the State of California attempts to govern the way in which a Florida public officer conducts official business (that being Notarial acts). I have been assured that this is being investigated by the appropriate departments. The Attorney General's office did document my assertion of an apparent Anti-Trust violation, and will be seeking a legal opinion as to whether or not that has occurred. I will keep you posted.
P.S. Thank you, Paul

Re: Lisa ... not to question your post..but..
Do you have an e-mail address or name of the person who gave you that information...I'd like them to see the e-mail sent to me by the NNA in response to my inquiry about whether or not the BGC done by Florida was sufficient to comply. I won't post it here again - I posted it a while back - but in a nutshell their answer is no - so the Governor's office may be interested in their stand..
E-mail me the information if you wish. Thanks.

Lisa
The interest In FL is most likely because others are contacting their Governors, Attorney Generals and legislators about this. FL was quick to respond. The see sawing by some companies makes the upset and confusion worse. Mention that the FL Governors office is looking into it definitely perks every ones interest. Including other States officials.

I am cautiously optimistic...
but still holding my breath. I plan on calling every day for as long as it takes to get answers to specific and pointed questions. As an aside, I did not mean to offend or give the brush off to anyone in other states, specifically JoJoMN. She asked me to forward the same information I sent to LindaFL, such as the name of the person in the Florida governors office. While I have no problem sharing the name of the people I spoke with today, I only meant that the SOS of MN, the MN Governor and the Notary Division of her state would be more applicable.

Re: Lisa
Yes, I understand that. JoJoMN was asking for contact names and numbers for Florida. My response was not to be rude at all... I just meant that those contact names would do her no good seeing as how she resides in MN.

Re: Lisa
I didn't take it as being rude, Lisa. You were right to correct me had I been asking that. I didn't read your response right and thought you were sending a reply that you received, not who the contacts were. I am looking for suggestions to try to get from the states in which I work, like you did.

Re: I received a call from the Governor's office today...
I also would be extremely interested in any/all correspondence as I received my first "do it or we won't use you" email today from a title company. I have lodged complaint, request for comments with FL SOS, but have not heard back from them. Can you include me on your list to share info? Much appreciated.
