Signing Agent vs. Notary

Had an interesting conversation with a fellow notary today...her contention is that we as notaries CAN NOT accpet e-docs to do loan signings, since that puts us liable for 'messing up' the package. For example, what if one of the docs doesn't get printed, etc. I'm curious what your thoughts are... She won't do e-docs ever. That sure would put a damper on my business!

This all speaks to experience and knowing what should be in the docs, reviewing everything to make sure that you have printed everything and doing the job as a signing agent. If she won't do e-docs she is limiting herself as you well know. As far as liability, I'm not sure how much liability we shoulder other than getting any missed paperwork taken care of at our own expense.

If you missed printing all of the documents, that would be a mistake on your part. You would need to make a 2nd trip at your expense to get the missing documents signed. It is your responsibilty to make sure you have all of the documents you received in the attachments before you leave for the signing.

Out of curiousity

Are you saying you go through every page in the file? By that I mean, go through the hard copy as you're going through the attachment? Or do you just mean making sure you printed every attachment?

I don't see where we shoulder too much of this burden especially being contracted through a service. It is my understanding from experience that the escrow forwards the docs or the docs are sent via the signing service. I always go over the table of contents if one is sent with docs, also do a final check to make sure all emails have been sent.

On different instances I have been notified and paid to go back out for pages they forgot to include in the package (their responsibility).

If someone will not do e-docs they limit themselves as to their ability to earn more income. I suppose it's just a personal choice.

When you print-out your docs just write down the number of pages and when you finish printing - count them!! I personally send an email giving the number of pages that I have printed out to the TC/Escrow company. It pays to take the time to do this (trust me on this one.) I've only had a problem once and having that count saved my B@@@, also keep those docs in a Secure File until you recieve your fee, again just in case. Always, always check for your key docs to be sure you have them. This just another helpfull hint.

Sounds as if you are annoyed because of Teds business smarts. You don't have to count every page but it is always good advice to check for certain docs in the package....it's called covering your &%$. He did however make a good point about saving the file until you get paid. I was able to collect on an account that owed me over $350 and they said I didn't do the signing.

What in the world is your problem?

You've got some knowledgeable, experienced people trying to share some great advice. Teddog is one of them. Why such childish posts? If you don't agree with something, try to articulate the reasons intelligently instead of acting like a brat.

By the way, your website needs some major work. Try spell check for starters. And what's with your profile picture? Do you consider that a professional photo? I don't. But hey, while your down on your knees...

Teddog has never been a know it all. Their are plenty of us around, but she isn't one. Maybe you need to spend more time reading the board and less time <trying> to put helpful members down.

Hi,
I'm very new, in fact I just had my very first settlement, however I'm kind a lost, about the package, how many copies I'm supposed to take with me, also do you must be certified signing agent to perform, i heard there was a new law passing in regards, is it true, does anyone know how it works in Maryland? please help!!!

Hello Speedy 10,

I am also new and have tried to figure out the new laws here re signings. I think you need to be a licensed Title Producer if you are the only one at the closing.
I bring both copies with me, one to leave with the borrower and the other to have signed and notarized
This weekend I am going to a seminar in PG county which is quite a distance from me in order to learn more... I am hoping it will help

Jjill, interesting post and this notary does have a point, however we are just one leg of the centipede (sp). The best we can do, being at the end of the loan process, is make sure we have the knowledge and the experience to complete this loan (or not) without giving false or misstaken information. I don't know or let's call your LO is always a safe answer.

As to the possible missing document(s). If a file is sent to you, it will print with all pages intact. Unless your printer is really old, even if it jams, it will print all pages. Just to be on the side of caution, I print the file and then print it again (Borrower's copy). If there's a page missing when I'm presenting them to the Bo (example page 3 of 4 and no page 4), then I check the Bo set. Usually not a page 4 there either.

If any Signing Agent is serious at making a living doing this, they must accept Edocs.

I suppose that would include not giving her hints on the spelling errors at her website, one that would show clients how detailed she is when it comes to loan docs.

Remember, signing agent is really a combination of 2 jobs: notary + clerical services (courier, printing, etc.). As a notary, you can certainly combine your notary skills with any other job you are qualified to do. (The "qualified" is why most of us cannot provide legal advice.) As well as being a PT signing agent, I work in a corporation by day and notary is only one tiny part of my job description - I wouldn't dream of telling my boss I can't print out a document that needs notarization because I might mess it up!
