TP 548 for you NY Notaries

When you get these blank tax forms in your loan packages. The Notary is not suppose to tell the borrower how to fill in the 4 page doc. The bwr doesn't know how to fill it in what do you do? If you don't fill it in with it get sent back to you to have them fill it in. I know I don't feel comfortable to have them just sign a blank form with their SS # on it. What do you do?

I'll call the Signing Co or loan officer. I'll tell them it's outside the scope of my position to advise people on how to fill out tax forms. They will usually instruct me what goes where. In the absence of that, they will only get the basics. I don't have that info, I am NOT an attorney and I will NOT be put in the UPL situation by someone who doesn't care to do their job.

Thank you that it what I did.

Now I have to tell them just put name and SS# and sign a blank form. I know they will get a bill from NYS for the transfer tax that they aren't expecting. I can't tell them that though.

No ... maybe you can't tell them that , but you could tell them to call their loan officer on the matter. Who should be able to tell them something .
Personally, I don't like being in that grey area of " I'd like to tell you something but legal restraints prevent me from it " However , it really IS IMO, for the best because it takes us off the hook in the event of any kind of finacial penalty.
If you don't mind my asking , Where in NY are you?
