Doed GLB require criminal,DMV and credit check? I personally will not give my SSN and/or DL # to anyone. I use EIN for tax requirement.

I e-mailed the NNA about this BGC since Florida does crimina checks as part of the commissioning process - wanted to know if that wasn't sufficient - here in part is their reply:
"The GLB screening performs county checks, state DMV records and federal terrorist watch list as well as a detailed felony and misdemeanor criminal records search."
In a subsequent e-mail I questioned if credit checks would be included - they told me no.

Linda, Thank you for your reply. I don't think the NNA reply answered your question. Is the answer to your question YES on NO? The NNA seems to have trouble answering what you asked. I am not interested in what THEIR screening entails I would like to know what the law requires.

Driver's License
I send them mine with the number blacked out. I copy it. Black out the number and copy it again so they can't read it through the marker. I have not done this gor GMN, but to other signing companies that request it. Never had anyone question it and get assignments from most of them.

Yes- what I posted was a portion of their reply as to what the NNA check looks for in compliance with GLB - Florida criminal checks as part of the commissioning process are not sufficient as they are limited - follows a copy of his entire reply to me:
"Unfortunately, no. Initial background checks for Notaries are not as detailed as what the GLB Act requires. In statesthat actually perform background checks the most detailed is a state and federal felony check. The GLB screening performs county checks, state DMV records and federal terrorist watch list as well as a detailed felony and misdemeanor criminal records search."
Again, in a subsequent inquiry he told me no credit check was done as part of this BGC.

I have requested my congressman to advise me to the requirements of GLB pretaining to commissioned notaries. Will let you know when I get a reply.

There is no GLB requirement for a background check
This has been discussed extensively and you may wish to do a search and find out what has been said. GLB reqires a procedure for keeping private information secure and charges the various agencies responsible for financial information to establish guidelines and then integrate the guidelines to come up with a recommentiation, as far as I know the FTC is the only agency with at rule. The NNA mis-information machine is at it again. My SOS states that CA's background check meets and exceeds GLB. I have requested the Ca attorney general comment and I have not received the information back yet. it takes the Attorney General a long time to make comments.

I have reached the same conclusion as charles. There is no stated requirement for a backround check in theGLB. This is a creation of the NNA as a money making scheme. I think , at least in N.J. and other states that a notary commission is sufficient

It looks to me, in reading the latest newsletter from NNA, that they are doing a bit of a back peddle on the background check info. Contrary to their first newsletters, etc when they made it seem that this was a government mandated check, they now tout it as being a part of their enhanced certification program. Either way, it still looks like a money grab for the NNA.
