I had a call from some P.I. down state. He was traveling up to get a statement from a family regarding alleged child abuse. Yes, I remember all the attacks I got about sharing this exact "such personel info on a public forum", still can't figure that out. Anyway, I was under the impression from his first call that he was getting a statement. When he called back it occured to me to stay out of it because he said he wanted this visit to be an element of surprise to the family and get in and out. I just decided this was a little big for me and as it happened, he came up and it was never done. Just a weird experience I'm sharing.

My 2 1/2 cents. (I cut a penny in half for this one).
First off, I don't think that AL notary law would require you to travel anywhere to perform a notarization. So in my opinion, you wouldn't be in any kind of violation. Besides, the person who signature you'd be notarizing didn't request you to perform your official duties now did they? Where's the violation for declining to notarize for someone who didn't even ask you?

That is a weird experience. I probably would have decided not to go through with it because if the P.O. wanted it to be an element of surprise, he doesn't even know what he is getting himself into. For all he and you know, someone could be waiting with a shotgun!! This was probably exaggerated, but nowadays I wouldn't put anything passed anyone.
I could see if the P.I. had been working with the family and knows everyone. From your description, it doesn't seem to be the case. I think you made a good call.

he wanted me to enter the home with him, with out an appointment and notarize their sigs on a statement that he thought he was going to get.

I wonder what made the P.I. think that they would be willing to sign an affidavit/statement? I hope he wasn't going to pressure the people into signing a statement. That's a sticky situation that I wouldn't want to be involved in. It would be different if the people knew you and the P.I. were coming.

Sometimes we don't pay attention to our natural
instincts. I do alot of signings in rural areas, most of them in the evenings. I've never really given it a second thought although I must admit I'm one to NOT want to become a statistic. The other night I had a borrower tell me "I'd NEVER go into this area in the dark by myself much less walk up to someone's house" and boy that got my mind thinking. I asked her why and she said because of the animals, bears and such that all seem to come out at night. NOW I call my borrower in transit if I see we're in an extremely rural area AND call them once I'm in what I think is their driveway. I once was in an extremely unlucky position and I remember the first thought that came to my mind was "this only happens on TV". Strange thought indeed but being human we lull ourselves in thinking we're bullet proof.

I know exactly what you mean Sue. I did a late night signing on Sand Mountain at the border and one of my friends told me she was happy to see me again. There is so much meth and dope over there, people sit in there windows paranoid, ready to shoot somebody. Nobody ventures up there after dark!

I agree. I believe the request must be reasonable. Now I'm sure there are some over-zealous, power-tripping, action-seeking (or nosey) notaries that would jump at an assignment like this, however I'm with you - refuse, refuse, refuse.

The PI must think he is invincible and that he does not have to abide by the laws of the land. What he is proposing is a quick trip to the hoosegow. Now, the papers have to be notarized, the police have to be notified, and the customers have to be compliant. I would do it only with a police standby and with the customers' knowledge that I am notarizing said papers. This I would tell the PI while lecturing him about his illegal behavior at best.

Remember
You determine if the folks are under duress. If you feel they are, walk. I wouldn't touch that one with a 10 ft pole. I worked with a PI once and he gave me references (Sherriff) and I had permission of all involved. But I met the PI for the first time in a small town cafe with the cook and waitress warching for my signal to call the police. LOL
