Fee from 2005
I was going back through my invoices for the last couple of years and and noticed that I never received a payment on a loan gone bad at the end of 2005. I sent an invoice and never received payment. Should I continue to go after it or should I let it go because here it is over a year later and I just realized that I never received it. What would you do? I guess business has slowed down quite a bit for me that I'm getting a chance to catch up with some old paperwork and looking for anything I can get. Anyway, thanks for your input. Art

By the way, it wasn't my fault that the loan went bad, the borrowers didn't agree with some of the terms and decided not to go through with it.

Whatcha got to lose? Can't hurt to try. Heck, some SOX signers have been waiting that long to get paid. LOL

I dont know about you but in my case I check every 1st of the month on my invoices "who is" past 30 days and start refaxing or re-emailing(sp)to whoever owes me money. And I dont remove the invoice from that pile until it gets paid.

CA Code of Civil Procedure § 337 provides for a 4 year statute of limitations for written contracts, http://www.leginfo.ca.gov/calaw.html. This is the time you have to bring a lawsuit. If you do not act in the timeframe set out by law, your claim is dead. If you have a written confirmation, you could still make a written demand letter and sue in small claims.
