NC Drivers Licenses

I was going to call the NCSOS on this. Females who are married often have their maiden names on NC driver’s license, rather then there middle names (most women wanted there middle names instead of the maiden but NC like to put the maiden name in there).
Example
Mary Jane Smith get married to John Doe, will read Mary Smith Doe on NC drivers license.
Now the docs read Mary J Doe or Mary Jane Doe. Besides the drivers license I ask for a library card or credit card to confirm the middle name. Then I do a same name affidavit Does anyone one know the correct procedure for this? I know someone else in NC had to run across this.

I'm in FL and since no one has responded yet:

Here's from the ASN website regarding NC identification:

"Acceptable Forms of Identification-
Personal knowledge
Satisfactory evidence of identification: A current identification document issued by a federal, state, or tribal government that contains a photograph of the bearer, and either the signature or physical description of the bearer.
The sworn statement of one credible witness who personally knows both the notary and signer."

I personally (and this is ONLY MY opinion) would not rely on a library card or credit card to establish identity. And I don't believe a Same Name Affidavit serves your purposes as a notary (again my opinion) - it's fine for the lender's purposes but does not satisfy identification guidelines.

If the current driver's license contains a photo, address and a signature, and the picture matches, the address is that of the property and the signature matches, and the name is "close", couldn't that be accepted? Where does it say that everything has to be exact ?

Call the SOS and please post their answer.

I call the title company in situations like this, tell them that they don't have sufficient ID to sign the name on the docs, and ask if they can sign the notarized docs as Mary Doe aka Mary J. Doe, and on the ack only use the Mary Doe name.

Here's what I have learned from the local DMV

I have had numerous drivers licenses with the maiden name used as a middle name and it ALWAYS presents a problem with CW/FSL and their redundant identification documentation.

It was explained to me this way by my local DMV: When women in Hispanic cultures marry, they will retain their maiden name and use it as described in your post... as a middle name. It STAYS with them throughout their marriage. American culture, on the other hand, is the opposite. In most cases, women will drop their maiden name and use their first, middle and married name as their legal, identifying name.
The situation you described usually occurs when the DMV employee is Hispanic. The employee will casually ask the lady renewing her license for her maiden name, and WHOOP! 'der it is! Bigger than life on her DL.
Like I said, not my opinion... just relating the information that was given to me by the local Driver's License bureau when I inquired about the practice.

Re: Lisa - I really wish Florida would standardize their

practices - here's the 4 scenarios I've encountered: (1) my own - when I obtained my new license here last year, told DMV I wanted my name as is - first-middle init-last (married name) - okay - no problem done; (2) DMV told wife signer she HAD to use her maiden name as her middle name; (3) friend transfers license in Stuart - says he MUST spell out middle name completely (exactly opposite what I was told for my license where I was allowed to use middle initial) and (4) the other day - woman went for license and they said "we'll put your maiden name on here - she hadn't used that name in over 30 years.

Re: Lisa - I really wish Florida would standardize their

Used to be Florida only used the maiden name as middle name. Used to irritate the heck out of me. But a few years ago when I got the renewal notice in the mail they said I could use middle name instead of maiden name, just had to take proof of middle name.

We think about this stuff all of the time. Problem is the...

mtg/dot should match how title to the property is held.
If people whould have deed conveying property to them at
the time of purchase, match the way that their DL shows their
name, then 90% of our ID problems would be eliminated.
If they subsequently change theri name later, they should have
a quit claim deed prepared , signed and recorded changing the
vesting to the way that their name now appears on their DL.
LO should check vesting and ID prior to doc preparation, but that
rarely happens

So I called the NCSOS.
Check the driver¡¦s license but sign as the document states not how the driver licenses read. Note it in your journal when you have them sign and do an AKA. Here is the funny part. NC has said that hey know this is an issue. However DMV does a through job in inspecting the paperwork and they are confidant that they are putting down the correct name. I laugh when she told me that. Honestly we have all been to DMV and I have never heard anyone ever use the words through or detail oriented ƒº
