I have received a call from a signing service.

They say that the til was not signed. I remember it being signed.

Anyway, I went back to get one signed. The borrowers work off hours. I left the til with the mailing envelope filled out fo them to mail it.

It has not reached the title company and I can't get hold of these people.

The signing agency is saying that there is now going to be trouble because they cannot fund. Have any of you had this problem? I am concerned now.

I can't imagine the TC would say the TIL wasn't signed if it was, perhaps you somehow missed it. These things can happen if you don't triple check the docs before sending them back. I would never have left the document for the borrowers to sign and send back on their own....it is your responsibility and if that means getting up in the middle of the night to meet with them then that's what I would have done.

You'll have to explain to TC and see if they have any other numbers for the borrowers so you can reach them.

Sounds like someone is trying to cover their hiney. If you remember one being signed and if this was edocs, I would of been comparing the 2 to see if any changes had been made. This has happeded to me and the hiring comp was using me to get the "corrected" doc signed stating the original hadnt been signed.

I did double check the signed docs.

I have been calling them no answer. She works from 6pm to 6am. He gets home at 930 pm. I will wait till 930 tonight and go over again.

It's just that signing agency is really on my back with threats.I just wonder how far this can go?

I've had one title company tell me this twice in the last month. This company requires fax backs, and I scan the docs and then email them to the company. I keep my faxback file on my hard drive for 3 months, then delete. I could prove both times that the til was signed. What had happened is their were last minute hud changes, they sent me out with new huds, but not the new til. They were covering their butts. That is the only reason I don't mind the fax backs.

Yep. TIL, HUD and the RTC not signed, they said. When pigs fly!, said I. Not only were they signed, but I had to make an extra side trip to get Nobs signature. They found 'em all. What a surprise--not. If they were just honest about it.... I don't tolerate the lies well.

Right on Lee, honesty goes a long way with me. I will go out of my way for comps that have been honest with me about their mistakes. Heck, we all make mistakes once in awhile. The purpose is to work together and get it fixed, not play games.

If I make a mistake, it's on my dime/time and I don't have a problem with that. If it's good for me, it ought to be good for them, too. Which is why I do triple check everything--I don't want to go back &, so far, (knock wood), I haven't had to.

Geez, maybe I'm missing something here.

You don't need a notary to get a TIL signed.

Why doesn't the SS or title simply fax them one and they fax it back.

I've had it happen (not the same set of circumstances as you) and the above solution was used.

Methinks the SS is making a mountain out of a molehill.

Edoc comparison will show if it's a revised TIL

I keep all of my edocs received for 6 months just in case there's a question. If the company has revised the TIL and is trying to get you to go back out for free to "correct your mistake", you can easily compare the one in the original edocs you received with the new one they want you to have signed. If there's a difference, you can say "Gotcha!" to the company. If not, it's hard to refute their word against yours. Anything could have happened at the company - they could have lost the signed TIL or spilled coffee on it or accidentally shredded it or whatever. Or it is just possible that somehow that doc didn't get signed at the closing.
Consequences of a loan not funding can be pretty drastic - expiration of locked-in interest rate, higher payoffs on the previous mortgage and other debts being paid off, etc. So it can be a serious problem if it is the notary's error.
Hope this works out for you. I've been accused a couple of times of not getting a document signed or leaving it out of a returned package, and luckily because I had the original edocs packages, I was able to prove that particular doc had never been in the package I received. Good luck!

If an error is made you must triple your efforts to correct.

these companies wait for the last minute to sign at which point all the responsability falls on the poor under paid notaries that is why you have to stick to your feesyou can have this problem with a $500 or a $50 signing

update:

I went and got the til signed. Faxed it and sent it on it's way.

Now after almost two weeks the ss emailed saying that the rtc and 1003 were not signed either and that the title company sent someone else to get them signed.

Now I really know that something is fishy. Ss is saying that our fee is being reduced and that we should be thankful that we didn't get sued.

This is nuts
