Another notary doing closings without a tpl....
A friend of mine that does closings in the area, decided to take a peek and see who is our new competition and run their name with the Maryland Ins. Admin. to make sure they are licensed. There is a lady here that is not licensed. My friend emailed her and started small talk, asking her if she was busy and if she wanted any "overflow" when my friend wasn't available to do the signing. The notary replied that she would love the extra business and thanked my friend. My friend sent an email asking for a copy of her tpl and she replied that she doesn't have one but is "thinking" about getting one.
She has been reported to the MIA.
Little Miss C____, get ready to be squashed.

Shame on the companies that are hiring her. She may not even realize you need one (although that's hard to believe). I have my suspicions about SS's hiring people w/o TPL's but what can be done about it? Report them to the MIA as well?

ok all kiding aside, bam she deserves it, however you mentioned squash and I'm baking butternut squash with a pork roast....yum! It just so happens that I called the SO and said "be prepared to get squashed!" He's just not afraid of me for some reason!

Firegirl, she can lose her notary commission and get a fine from the MIA.
Charm...she is going to be saturated by calls from the state and other notaries here that are doing this the "legal" way. Is that better? I am going to the clerk's office in the morning and find everything in the last 6 months that she has notarized and then contact the title companies and lenders. That will wake her up.

How easy is it to find out what she has notarized? Does the clerk's office reference the notary's name?

You better believe it is recorded with the deed of trust. I work in 6 counties doing title work and when I get slow (like I am right now), I start looking at the new notaries in my area and then take a look at the MIA website to see if they are licensed. Most notaries around here work for attorneys and as long as they are under his supervision at the table, they are not required to have a tpl, but the others that work for title companies that I know are shady, I call the MIA on and my friend emails them "looking for a friend" so we can dig up dirt on them.

Any mortgage (or any doc for that matter) that she notarized wold be invalid. What a trip. Could you imagine the nightmare that would cause??

FYI it is the law in Maryland that you have a title producers license to do loan signings. Anybody that does it and the companies that hire them is breaking the law. Not to mention taking money out of the pockets of those of us that are doing this legally.

im not saying i agree with this but to do this to people for no reason cause you are a mean and bord just seems cruel to me, i am aware of the state requirements but there are other things she can do as a notary that does not require to be lisensed.

DUH! I just explained to you that it is ILLEGAL...so to me (and other people trying to do this business legally) it is not for "no reason". If a notary admits that they do not have a TPL and someone were to go down to the courthouse and look up mortgages notarized by said unlicensed notary then that would be proof that there was wrong being done. It's not about being mean and cruel it's about people spending the money and time to do things the right way and then having ingnorant people who have no business doing loan signings taking work away from us.

Let me ask you this ... hypothetically, the BO is O/N the docs and told to go find themselves a notary. The BO then locates this Notary that you are demeaning who simply "notarizes" the BO's signatures on the forms that are in the package. Has this Notary still violated the law? According to your own explanation, she has NOT. Wouldn't it then become dependent upon you, to be able to prove that she sat down with the BO's, explained the documents, etc and then notarized the docs?

She can do other things as a notary, you are right, but the point just went right over your head. She admitted to do closings without a license.
Parker, I am not bored, a signing agent is just one hat I wear. I have owned my own abstracting company for 11 years. This young lady is breaking Maryland law and every other licensed title producer in Maryland feels the same way I do, comply with the law and we don't have a problem with free enterprise.
Please, link your profile to your name when you start throwing stones, so I can get an idea of who I am talking to. And use a capital letter when you start a sentence.

How would you feel if you lived in Maryland and closed on your home loan and the notary was not licensed and did a mobile closing with you, and 3 months later, the lender called the mortgage because the notary was not licensed. Good bye loan, you are starting all over again.

IMO, the closings would be valid, since she is a notary. The problem would come from the MIA and maybe the title company.
