Can you believe this?
Talked to a broker friend of mine today. He had been told by a title company person that it was not necessary for a signer to appear before a notary for an acknowledgement. She claimed that she was taught that at a seminar! Either that seminar was given by XYZ or she misunderstood that under certain conditions (not real estate related) you can use subscribing witnesses.

sadly she prob was taught that... too many that give info that do not have a clue what they are doing................

Think about the auto dealers - they do it all the time
Sadly, in the new car dealerships, they have buyers complete the paperwork without ever seeing a notary even though there is at least one document that requires notarization. Twice, when we bought our new truck and later our first new car, I pointed out that "This needs notarization. Where's the notary?" And I was told airily that "She's not here. She'll take care of that tomorrow when she processes your paperwork." When we bought our second new car, it was during regular business hours, and I insisted that the notary come down from the office and do her job properly. Everyone acted like I was just being eccentric. Later, I asked around and learned that it is standard practice in the auto industry. The notary never sees the buyers, and they never see him/her.

years ago I worked one day a week at a regional auto auction - one of the biggest most respected ones in my area. I worked at the front counter - after a dealer purchased their vehicles, they came to the counter, I got the paperwork and they signed, etc. The paperwork went to the 'back room' where everything got notarized. THOUSANDS of cars every Wednesday.

Hey Sue, that wouldn't happen to be an Adessa Auction, would it? I used to be a Wholesaler in my previous life and attended just about every dealer auction in the country! We might have met! : )

I would like to share my recent assignment which was redone aftere a young man, who notarized a loan without appearance one of the borrower. If he reads this forum, he knows what I am talking about. The only thing I can disclose, a family is italian. Moreover, he did not attached CA loose certificates, misspelled borrowers's names, e.t.c.
