E-Loan
Tonite I get a call from them wondering why I'm not at the borrower's house at 8:00 - it's now almost 8:30 and I just got in from a closing. I told her I knew nothing about it. She swore up and down she talked to me last night...didn't I get the confirmation? I said lady I never talked to you or anyone last night about this closing tonight. I know nothing about what you are talking about. Meantime borrower is buzzing in on call waiting....tell him I'll call him back and back on the phone with from E-loan. So can you go now? No...I'm on my way out the door with my husband for the evening. We already had plans for tonight. I can do tomorrow. Ok let me call you back. Now mind you the borrower has the docs already but I already made plans. She calls back and says ok you can do tomorrow - in the meantime the borrower is wondering what's up. They only knew about this this afternoon...she says she'll email it to me and to let her know if I don't get it - she'll be there another hour. 15 minutes later I call her, no confirmation...leave message with alternate email address and on my out the door with my hubby. I ask her to call my cell and she doesn't. Now it's almost 11 pm and no confirmation and no call. No confirmation no closing. The borrower asks how much am I being paid. Tell her I can't disclose that. I think they are at the point they will just pay me out of their pocket because they have the docs and want this done. Now before you yell at me like the last time... I want your opinion - if I can't get a hold of them tomorrow (E-loan) do you let the borrower pay you directly?

I would definitely deal directly with the borrower. No confirmation means no deal with E-Loan. Let the borrower pay you directly, let him deal with getting the notary fee back from E-Loan. If they're stupid enough to STILL not send you a confirmation after dealing with the mess they made in the first place, then they don't deserve to be part of it.

I would directly deal with the borrower. I would charge her the $150. After the signing I would tell the borrower that to tell the E-loan she took care of that and I will send the package myself. JMO

Closing complete - got my check and the borrower is going to call E-Loan on Monday to get my fee refunded from the HUD. I'm sure I'll hear an earful from them on Monday but not my problem they have incompetent people working for them.
