Have loan docs, but no confirmation from agency

I know it happens, but it hasn't happened to me yet, but....

What do you do when you have the docs (lucky they got here because they had the complete wrong street address for delivery), but you don't have the confirmation from the signing agency? I've tried contacting the SA sevearl times (left message), tried paging (no response), and signing is supposed to be tomorrow. I don't like to go out without a confirmation because I'd like to know who to bill and be fairly sure I will get paid but especially don't want to let down the borrower (whom I haven't contacted yet).

What now?

no confirmation...no job....it might have cancelled between

the time docs were sent and you are notified...contact the borrower to confirm whether or not the loan is still on....if not....destroy, destroy will robinson....if the signing is still on...try again to contact the sa....if you still can't, it's up to you whether or not you want to work for free. JMHO.

Destroy the docs? Are you kidding? What if the borrower changes his mind after a call from his broker?

yes...if, after contacting the sa, bo and all parties

concerned....if the loan is called off, destroy the docs. IF the SA states that these docs can still be used, then of course don't destroy them...but usually they are date specific, or have a lock associated with them and MUST be used on a certain date. If they are NOT used, then they will have to be redrawn with the correct day...and the old docs shredded.....(or don't you do that out on the left coast?)

Very few of the loans I sign in CA are date sensitive. It's very very rare for docs to have to be redrawn if the signing is pushed back a day or two.

I make sure I hang onto unused docs for at least couple of weeks before I shred em. It's usually longer just because I'm too lazy to do it on a regular basis.

Juts because a signing adjourned doesn't mean the loan is dead, or the docs are no longer valid.

I don't shred anything unless my client tells me to (and especially not docs that were overnighted), or until several weeks have passed. Not every lender demands that the docs be signed on the date they were drawn for - I've had more than a couple where the docs were dated a day or two earlier, and there was no problem with signing or notarizing using the current date.

If the signing service can't be bothered to send you a simple confirmation or can't be bothered to return any of your several phone calls or bother to get your address correct on the docs, what do you think the odds are that they'll bother to send your payment out?

I'd say that if you have the borrowers phone number a white lie might be in order and you can say that you never got the docs. That sounds much better than trying to get them to understand why you have the docs in your hand but won't come to the signing because the company that sent you out were being such flakes.

The borrower will live if it's delayed a day or two. Better him being inconvenienced than you being unpaid.

I am guessing that this is for Saturday or Sunday. The SS may not be in the office. I received the docs and can not get in touch with the SS for the confirmation. Myself I would call the borrowers to confirm , guessing that you could not confirm because no contact information on confirmation to confirm, and see if they are still on. I would go ahead and do the signing. On Monday I would try to call the SS one more time to see if maybe if someone forgot to send the confirmation. If I do not hear anything and I can not get in contact with anyone I would call title directly and explain the situation that I went ahead and did the signing becauise I did not want to anything to delay the closing of the loan. Then I would make sure that if I did not hear anything from the SS that I would be able to invoice them directly. I just feel that right now as the business is slow ,or even if it was not, that we need to be a team player in this.
It might just earn you some brownie points. JMHO!!!

It depends on one of two things for me

Have I worked successfully with this SS in the past? If so, I'd do the job. If I've never worked with them before, but they have a positive reputation here, I'd do the job as well. Of course, I wouldn't do any of this until I confirmed with the borrower that they were still expecting someone to come out (their phone number should be on the application).

That is what separates us from the $50.00 notaries. One time I had a title compant tell me that the wife was to sign only marital docs. Well after one look at the 1003 that was a totally different story. Had a 50.00 notary gone out it would have been resigned.

I'm guessing that you mean that you called the title company for direction after noticing whatever you noticed on the 1003, and not taking matters into your own hands as to who should sign what. I had a similar situation where I was told there was only 1 signer. There was only one name printed on all the docs. After looking at the 1003 for a different contact number I noticed the 1003 stated that title was to be held in both the husband and wife's names. I called the title company to confirm that only 1 needed to sign. I was told that the docs were correct, whoever took the loan application did not know how title should be held.

My point just being that if you think something is wrong you should contact someone in authority for guidance.

Definately. The point I was trying to make is that someone with less experience would not even contact title with the descrepencies (sp?) and just do as the instructons said.

Yeah, I guess I should have included that. If it's a company that's been good to me already I'd trust that things would still be the same. My comments were meant for unknown companies, which I'm guessing was the case in this situation as she stated she didn't even know where to send the invoice after the signing.

I'm with DebbieT.

Call the borrower(s) and confirm that the signing is on.

We do not know whether the rate lock will expire, et cetera. If we have the documents, we do the signing and worry about an actual confirmation later.

Yes, I agree, also, that that is the difference between a $50 alledged Notary and a professional Notary Signing Agent.
