M. David Spear of Richmond, VA
I was stupid to agree to handle a closing for M. David Spear in July, as I had read negative posts about him on this forum. He gave me a song and dance about a glitch in a new computer system. He has not responded to emails, faxes and the business phone has been disconnected. His cell phone - 804-245-9458- is still in service, but he has not responded to my messages to his voicemail.

Zabasearch.com has a listing (in the same geographic area and zip code of a previous forum complaint posting) regarding M. David Spear. There are a few other possible M.D.S. Virginia listings on Zabasearch.com that may assist you in finding the correct individual. It is a search engine used by a lot of paralegal/investigators that is free. I am not stating that this one I've listed is your skip trace, only that there are a "handful" of M.D.S. in VA listed that you may want to research in order to possibly narrow down your list and possibly make contact to hopefully find the right one. I deleted the address number and last three digits of the phone number for privacy reasons (e.g. business versus a home listing, wrong individual, etc). If his voice is on his cell phone's answering message, you may be able to reasonably match it with the people who answer the phone (or not). Public records can be very useful... Wishing you the best. You can find his profile under zipcode 23112 which list all of his contact information. He has ripped off many notaries including me for a signing I did in June 2007. He is not responding to collections. How can the State of Virginia allow such a ripoff artist act as a Notary Public?

It is called limited liability...the purpose for which corporations and LLC's are formed. If the entity is incorporated or an LLC satisfaction of contract claims are limited the assets of the corporation or LLC. However, torts may be another matter. In Connecticut corporate officers and members of LLC's are personally liable for their torts whether they are perpetrated in their personal capacity or in their corporate representative capacity. However, tort suits are harder to prove than contract suits.
There is more flexibility in suing a partnership. There are legal theories in Connecticut by which both the partnership assets and the personal assets of the partners are subject to collection claims.

I think this is a lesson for all of us to learn, when there is a negitive repoor against some one that should be a red flag to you don't do it. thats sad to hear that you got ripped of by this guy.

Seems he has a relative named Patricia Spear in zip code 23112. Same package address. Try contacting the Virginia Secretary of State to complain about him. He is a commissioned notary, securing notarial services from others, but not paying them.

Lynn - contact the Notary Director for the Comm of Virginia. She is Betty Anderson. Try (804) 786-7296. He is a Notary, commissioned in the Commonwealth. Hope this helps but he is a deadbeat.

I have wrote in my profile and am serious about that a notary public is a sworn public official of the state, and as such is permitted and restored for the withholding and/or nonpayment of notarial services which constitutes theft, punishable as a civil act. I am also a victim of M. David Spears and have already sent letters to both Sect'y of State and Va insurance commission as Va is a title producers state. I may never get paid but am hoping that we can get him stopped. Everyone that he owes money to needs to write letters.

I received an email form Betsy Anderson, head of the notary section of the Commonwealth of Virginia, stating that they do not get involved in contract disputes but she would make a note in his records. [e-mail address] Small claims court would be a good option for notaries owed money in the Richmond, VA area. JMHO

Try the local HUD office in Richmond. 800-347-3735 Wm. Miles Direct 600 E. Broad St. Richmond, VA 23219 also phone numbers 804-771-2100, and 771-4891 File a complaint and ask them to check on funds disbursed according to HUD Settlement Statement.

Hi Everyone,
Mr. Spear owes me $230 for a closing back in August and has not returned phone calls. I am filing a suit in Small Claims Court if he doesn't reply to my voice mails by Wednesday the 19th. I plan on asking for my signing fee that he owes me, late charges, filing fees, and travel expenses. I went ahead and called the Chesterfield County General District court for all the information and I thought I would share just in case someone else wants to take him to Small Claims Court as well.

Filing Fee: $36.00 Sheriff Serve Fee: $12.00
If you are like me and don't live close enough to pick up the forms from the court house, then do what I did and fax a request with your address to (804) 748-1757 and someone from the front desk will call you to confirm (they are really nice and helpful) and send the forms to you via U.S. Mail. I should have mine by the middle of next week and I will send them in on Friday.
I will keep you guys posted and let you know as soon as the Sheriff serves him.
