POA ??'s

Hi,
I have a signing sked for tomorrow with borrower's sister signing with POA. Borrower is out of country, prpy is out of state (VA). I'm in NM. I have docs already. Whose info do I put on the applicant ID page? Borrower's name/dob is pre-printed. I've only done a couple of POA signings and those were for a spouse with health issues. Any input, tips hints would be GREATLY appreciated.

You can't obvisously attest to borrower's id since they are not present. Although you should probably just leave the pre-printed info in there and also record the POA info somewhere on the id form or on another form, if needed.

So, are you saying to record the id of the person (sister) holding the POA on the form somewhere? Maybe in co-borrower spot, but indicate POA as "attorney in fact?"

If there is an id form included I always record everyone's id on it. For example, if vested title holder has to sign: I cross out pre-printed "co-borrower", write "vested owner" & record that person's info. I have never had an issue doing this & figure more info, esp. re: ids is always better.

Do yourself a favor and call the company you received the assignment from and ask them how to proceed with that page for the closing. They will probably send you a complete different type of ID form to use. In this case you've the person signing with the POA isn't on title and the info for the borrower isn't available to you. I would get a copy of the id from the person signing with the POA and an orginal of the POA to return to the company.

Just an aside...
I know it's not up to us to look for errors in the documents, but in VA the notorial wording and notary's signature must be on the same page as the signature being notarized. I've had to have the title co. redo some documents ecause of this rule. This is extremely important for DOTs - they won't record if the above is not followed.
