I was 1099 ed from this SS for money I am still fighting for meaning I didn'r receive yet from them. Is this legal? and what should I do now? I am not going to pay taxes for money i did not get!

Send them an e-mail/letter/fax stating that you haven't received the amount they said. Imply that there may be some "creative bookkeeping" going on. Also, say that unless you actually get the $$ owed, you will have to notify the IRS that there is something wrong and that they are reporting expenses that they had not incurred. and you feel the situation needs to be investigated. See what their response is.

Call em up and politely explain their error...
and tell 'em you're gonna hold up reporting it to the IRS until Friday while they cut your check.
I give it a 20% chance, but what the heck, it's worth a try.

Hey Folks geting OVERSTATED 1099's
If it happens once, no biggy. I got one just a tad over what my books say... I'm pretty sure they called a January payment December and I didn't... no big deal.
But if there's a pattern... well that's a scoundrel that needs to go away.
It'd be good to Private message each other... and if a common thread is discovered one or all of you can report it on the IRS website.
You can even get a cut of any tax they have to pay as a result.
If there's a company or two doing this systematically they richly deserve an audit.

I would be interested to know if the well known deadbeats like SOX are over reporting what you are receiving and If they do 1099's at all.

I agree with a nice call to the company explaining the error, is the best way to handle something like this but if it does not work here is another thing you can try. I was a waitress for years and employer always declared more tips then we made. We always just turned in our tip logs with the employers information and told the IRS it was the employers errors. So in short keep good records and be ready to show them to the IRS you will be fine. You can also call the IRS and talk to them and explain to them what happened. Good luck.
