Prompt & Precise Closings LLC, Trinity, FL
Hello all. Just wanted to share my experience with Prompt & Precise. Last post about this company didn't shed much light (Nov 2006).
Performed signing 1/5/07. Fair fee. Faxed invoice "reminder" 2/20/07. Received check 2/26/07. $25 Short. Faxed invoice "fix-er-upper" 2/26/07.
I'll post the resolution when it happens.
Have fun!

Gee, gives a whole new meaning to the words "prompt" and "precise" doesn't it?

NEVER AGAIN
On 8 /29 I received an order for 8/31 from a title company I worked for for years.
Shortly thereafter she calls to cancel - says broker insists they use broker's signing service.
Minutes later I receive a call from Prompt & Precise for same tiny little town, same date & time. Although I seldom work for signing services, I accept the order knowing exactly what to expect from title company. By the way, I can't remember but I believe she wanted to pay me $75 or $100 - I told her I needed the $200 that I had agreed upon w/title company and she agreed. Her confirmation says - "I will pay you $200.00 for this closing upon the disbursement of funds of the loan." I also know that she was receiving a very healthy fee on top of my $200.
Order (with my several times repeating borrowers- now my 'friends' after being there no less than 5x) goes without a hitch.
Loan timely disburses on September 6.
I am VERY patient when it comes to payment and collections. On October 6 I send an overdue invoice. No response.
On October 23 I fax her a demand letter, copying the title company, broker, lender and she thinks the borrowers (if they had a fax they would have gotten a copy but they don't have a machine). She replies that she hasn't been paid and she will NEVER (her emphasis) pay someone until she gets paid. She's going to contact title company to see what's going on. I know that this is a VERY slow paying title company but I've got no problem with that when I work for them directly. However, she said she pays on DISBURSEMENT OF THE LOAN. Perhaps she doesn't know what that means. Waiting for a title company payment is one thing - a signing service that is responsible to no government entity is something else. Besides, she just opened for business in June - no history for her company - and she's working off someone else's personal telephone line as her business line.
November 14 I am fed up. I contact the owner of the title company and the broker with a copy of my small claims complaint to be filed on November 16 at 8:30 a.m. One of them - the broker I think - contacts her and lights a fire under her although she continues to play her games all day long. She calls with the message that I am 'unprofessional' for 'unnecesswarily' contacting these other parties. Okay, her promised DISBURSEMENT was September 6 - we are now at November 14 - maybe she doesn't know what such a big word means. She calls me several times (I don't answer - ain't caller id grand?) and wants me to call her back. I don't. I e-mail her and say I'm not calling - nothing to discuss. She then e-mails and says she needs a W-9 and she'll MAIL me my check. I tell her that she's had my EIN since 8/31 as it's on my invoice. I also let her know that she had better overnight it as I am filing suit on the 16th as I stated, not waiting for the infamous 'check's in the mail'.
She overnights the check, including the accrued interest - the "I will NEVER pay interest" interest.

Attorneys in Connecticut are in a slightly better position. They have a common law lien on the file equal to the amount of their unpaid fee. The lien travels with the file and transfers to the proceeds the file holder receives. Ultimately the lender is the last party to take possession of the file subject to the lien. The attorney can enforce the lien against proceeds of payment received by those who had come into possession of the file and ultimately against the lender.
