On February 2, 2007 I did a signing for CA notary Inc. It was the last minute signing, they called me at about 2-3 pm and asked if I can do signing at 5pm. I accepted the offer even though it was only $75. They were very happy because it was really a problem for them to find a notary(it was friday, plus last minute signing, plus only $75). I did have no time to read all their instruction almost by the time of signing. One of their terms was to FAX back the documents with borrower,s signatures and Agreement that I have to sign to accept all their terms.I sent documents on Saturday(next day) morning, call them to give the tracking number but did not fax the documents. On monday they told me that they were going to deduct $25 from $75 because I did not fax the borrower's documents and they would not pay me at all if I don't sign and fax their agreement. To sign the Agreement means to accept to deduct $25, I refused. I explained that it was last minute signing and I did not have really time to go through documents and find out that I had to fax back documents when I was already by the borrower's house plus I paid $18 for printing(e-docs) and if they deduct $25 I would get nothing. They told me that I could refuse to do this signing. I left a message for the manager nobody called me back. More than that the borrower called me later and asked how much the company had to pay me. I told her $75. She explained that the company called her and told her to pay them $200 that is how much they had to pay me and if she did not they would not me. Today the borrower left a message that the company insist to pay them $200 or they would not pay the notary. She is asking now if she can pay me $75 and the difference late to the company. What to do?

Larissa, People will yell at me for this but this is one situation where I'd stop taking calls from all the parties and move on whether I got paid or not. This is a negative, energy draining situation. You charged too low to begin with. You are only losing $75 plus your CODB. Heck with it. Move on and never take another signing from these nuts again. Any more time involved with them is time lost.

The only other thing to do is to tell the bwr to contact their lender and the title company to find out if they are being made to pay twice for the notary.

there are times when you have to look at the whole picture and what you will get for your efforts. Hopefully Larissa, will put more of a plan into effect before taking on more signings. Needless to say her fee was too low and her taking any more assignments will only go to the benefit of the bottom feeding signing services that will take advantage of her. No offense meant to Larissa and others like her, but they probably fell for the hype of the NNA and the untold millions to be made in signings.

Strike the clause that says they will deduct 25.00 for

failure to do fax backs, intial, and sign and send back. A legal and binding contract and start collections if they refuse to pay full fee. PS. You sure did't live up to the name of your company by taking a last minute e-doc signing for so little, and then disregarding their instructions. JMHO

If you pay a turn around the efaC. Thanks to it, now anyone can be a signing service...all you have to do is pay your upfront cost and a monthly fee to access the database and you can farm out signings til the cows come home. Experience isn't necessary, as I understand it.

Larissa your msg indicates you didn't ship documents until Sat morning. Missing it Fri night is one thing, but not to check everything before you ship the doc's out is another. Experience teaches you that one of the things you must do is check the entire packet until you are very, very, very experienced. You never know when something "special" might be in there.
Unfortunately we all make mistakes "cutting our notary SA teeth". These mistakes also teach us not to do it again. I'd say "lesson learned" and move on with your next signing and a mental note to be more careful.

Whether they were mailed on Friday or Saturday makes no difference they would still get them on Monday.

Carmen I believe reminding her if she did not have to ship

on Friday pm, she had ample time to review the docs and the instructions on Saturday before shipment for Monday delivery:-)

I did check all documents on Saturday before I ship them, I did not check all instructions before I went to do signing. Thank you everybody for your messages.

We don't always have time to go over the docs while they are printing. However, we do have ample time to go over the loan package while we are with the borrowers. YOU dropped the ball on this one.

What about the company demanding $200 from borrower????

That seems to be an absolutely disgusting thing to do. First, the company LIED to the borrower by claiming they paid the notary $200, which they were attempting to pay her only $50. Why is the company attempting to collect directly from the borrower? Signing Agencies normally get paid by the title company after the loan funds, right? It's on the HUD how much the agency will get as a closing fee and is paid from the loan proceeds, right?
First thing I'd do would be to ask the borrower to please contact the Loan Officer and find out if the closing fee was supposed to be paid by the borrower directly to the signing agency. And I would also contact the Loan Officer or the title company to clarify this situation. If the signing agency was attempting to collect directly from the borrower while also being paid by the title company from the loan proceeds, I'm sure the Loan Officer and title company would be very interested in that information.

handling this kind of last minute transaction in your profile. You did not live up to that. Let the company know up front that if their edocs are late you must take a brief moment to review and clarify any docs you have questions about, then proceed to your closing. If this means that you are late because they did not get docs to you in enough time to get to your appointment, that is not your problem. First communicate with the borrower, then tell Title Companies and Signing Services upfront that for last minute closings you reserve the right to review documents and clarify their instructions so to complete their assignment accurately and leave it up to them if they want to find someone else. Late docs do not mean you lower the professional standards you set. It means without question you do what you say you are capable of. My professional opinion is that it is a waste of time to try to collect. You can justify why you want to get paid all you want, they sound like excuses, lesson learned move on and think about the standard of work, what you should charge for it and live up to it. If we are ever going to survive in this business, we need to live up to our claims of service. Every one of us has made a mistake or two......move on from this one.

I am disturbed about the fact that this company is trying to collect from the borrower. I would encourage the borrower to contact their LO and see if that was indeed agreed upon that the borrower should pay the SS $200 out of pocket. Have the borrower go over their HUD and see if the fee was already accounted for. Sounds fishy to me. JMHO
