Background Check Update
My apologies for the long delay in posting this update...
We have spoken with several title companies about the need for background checks and what their expectations are. While we have learned a lot in the past couple months, there is really nothing new to report related to the NECESSITY of background checks:
1) The law does not require that a notary public submit to an independent, and possibly redundant, background check in order to perform their duties.
2) Lenders certainly have the right to request that their agents (title companies) and their agents (notaries public) submit to background checks before representing them as a vendor. Title companies have that right, as well.
3) Certain title companies offer free background checks to their agents, a cost they bear.
4) Many companies consider existing, third-party background check certifications to be inadequate and are unwilling to recognize them.
5) Companies may not recognize "free" or consumer-oriented background checks because they lack the scope of a more intensive check.
With that said, we cannot escape the reality that many companies are currently requiring background checks or are working toward that end. For that reason, Notary Rotary WILL BE SUPPORTING the Notary Public Background Check (NPBC) Certification initiative.
The NPBC Certification is scheduled to go on-line on February 1, 2007, at http://www.notarypublicbackgroundcheck.com. (Long name, huh?)

I would like to thank Harry for his hard work, for his establishing this site which in spite of it's occasional upheavals, continues to be a source of information and education for signing agents. Harry's efforts at providing an alternative to the XYZ faction, flies in the face of the typical profiteering philosophy of certain interests. Thank you Harry!
