CA Notaries

Does anyone have a form/letter "Power of Attorney" stating in case I’m catch by the INS or get deported I "persons name" give the power of attorney to "any name" to take care of my two sons " any name" "any name"

The parent is an immigrant and her sons where born in the U.S. Father is passed away. Any help is appreciated, thanks.

Israeil I thought you work for a Legal Office or an attorney's office or is some other Israel?

POA forms are easily available at business/office stores and must be properly filled in by principal with a designated person.

I agree that the person with this request needs an attorney. The care of minor childern is usually dealt with the use of conservatorships and with or without a POA or conservatorship, a minor child in California is always subject to the review of juvenile court. It is available in both English and Spanish.

However, I cannot stress the need for this parent to consult a qualified family law attorney.

For pete's sake folks. There is no "power of attorney" for children. There is either a mother or a father - that's it.

In the absense of either? The courts will rule. No document can overcome that.

Why do notaries get involved in these things? You're totally over your head by even asking the question.

Clarification, I thought the question was regarding a parent using a power of attorney to “to take care of my two sons.” It sounded as if a parent was trying to give another adult the legal permission for to act as parent for the child in the event of their absence. There are many instances when parents anticipating their future unavailability provide for another adult to care for their children as to school enrollment, health care and insurance, etc. However, since it would be the UPOL for a notary to suggest which form should be used, I referred the questioner to the official self-help legal guide available from the California Courts, or seek competent legal advice.

You are correct (with few exceptions) only adults can validity execute legal documents.

Alas, since I am new to this forum, this is not the first time that I have missed the point of some of the comments….

What you're doing is Unauthorized Practice of Law (UPL). Stop now.

As much as Notaries Public want to help, we're not attorneys. Do not get sucked in to providing legal advice. Especially to an illegal alien!
