HELP!
I am a notary in CA and I have a family emergency. If my sister signs something stating that she gives up the rights to her child can I notarize it? I am the one who will be taking him.

In most states you can not notarize a doc where you have any interest in the outcome either monitarily or otherwise. It is called conflict of interest.

I don't know CA law, but ethically I would definately say CONFLICT OF INTEREST...and I wouldn't do it! JMHO

No, you cannot notarize something that you have a beneficial interest in. This is in your handbook.

I would suggest your sister...
call a family law attorney for help with something like this.

If you don't know the answer to this, I suggest you turn in your commission or take another class.

It takes a heck of a lot more than a notarized statement to terminate parental rights. Why should one of us waste our time on something that's completely meaningless?
