How would you handle this?

Received a call Friday evening at 5:00 pm to do a signing at 7:00 pm. First time with this ss. He emailed info over twice then called to say disregard first email as bo phone number was incorrect. I called bo and left message. LO sends over information to go to their site and download docs. My business number was not on the paperwork from ss so this lo looked my home number up and calls on that line to say she had sent some incorrect information and to disregard her first email. She the borrower was waiting. I let her know I called and left her a message. The appointment was tentatively set for 7:00pm prior to my connection. At 6:30 still no reply and this will take me 30 minutes to arrive at bos house. I called the ss and sent and email. No reply. I call the lo and left message, no reply. I called the bo at 7:30 and leave message and no response. I called both the lo and ss after the 7:30 message and still no reply.Everyone was available and then poof! Saturday morning I called lo and ss, still no reply. So that's where I left it. Went to a gathering with friends last night. I arrived at 3:00 to assist with food etc. I'm up the mountain where reception on cell phone is not great. I go into the room where my purse is and hear the buzz, I look and guess what? The bo called at 4:00 yesterday to say I'm not sure when you called, just received your message. You can come over and sign tonight or tomorrow morning. It was 9:30 pm when I received her message.I have not called her back.I will call her. Ok, so after all of that. What would you do? TIA

As there was a confirmation I would have gone to the original appointment even if I had not spoken with the borrower. I would have done this even if the LO had not called to say the borrower was waiting.
Now I would get in touch with the borrower and go as soon as they were available. I would notarize with the actual signing date and hope the docs are not date sensitive and I would let the SS & the LO know as soon as possible.

I didn't already have other plans. If I had other plans, I would have called and told the L.O. that I did and give her the contact info for a couple of other local notaries who might be available, then call those notaries and give them a "heads-up" on the possible closing.
I would not change my plans that evening since you've already given them plenty of time to get edocs to you, and they neither got the edocs to you nor kept you informed of their situation.
And I'd make very very sure they didn't expect the docs to be backdated!
It might be possible to turn this into your first closing of the new year. Did you check with the various notary boards for input on the SS?

I believe she had the docs although it is not totally clear.
Obviously no docs=no go.

No, bo did not have the docs. Edocs and I downloaded them on friday night as I was advised borrower was waiting for my call. I called and left two messages and did not receive a call back from bo until yesterday at 4:00. LO and ss have not returned my repeated calls or emails that I immediatley started after no response from the bo.

I did not mean the borrower had the docs. The she I was referring to was you.
Again if I had the docs I would go even if I had not been able to speak with the borrower.
This is just what I would do and it may well be easier for me as I don't go more than 20 miles unless they want to pay $$$.

Got ya. The borrower just called me back. Apparently she was out of town. Just got back yesterday afternoon. She apologized that she was not available friday night, although no one knew except her. Now she (bo) would like to do the signing today. Still cannot get ahold of lo or ss. I will go today, fee was set for friday, it was acceptable. Happy New Year and thanks for your input.

That would be great if any of the parties would have contacted me. I called the bo a couple of minutes ago and got her voice mail again. Aslo emailed and called the ss and lo a few minutes ago. Guess I will wait once again. I would never, never back date anything. SS looks good on all boards. Not sure why no response. Thanks for your input

This is what I do

When these situations arise. I do not travel unless I have confirmed the appointment with the borrower. Why? Way to many of these SS's will not pay for the extra trip if the borrower wasn't home. They will tell you "you should have confirmed with the borrower before you left" (been there, done that) The documents probably are date sensitive and will need to be redrawn, but it's not your fault. You tried to contact the SS & LO and they failed to respond, so the ball is in the SS's hands, not yours.

I agree, I donot travel without confirmation for the same reasons. I was thinking about the date sensative issue as well, although the lo told me that shipping fedx on tuesday would suffice. Therefore signing today and shipping tomorrow may still work? The bo called me back awhile ago and we have it set for 11:30 am today. Hopefully all will fall into place, she gets her money, I get mine and so 2007 is off and running. Happy New Year and thanks for your input.

If I'd not been able to get ahold of the borrower, I would not have printed docs out, nor would I make the 1/2 hour trip on a Friday leading into a holiday weekend. I've had loan officers tell me "the borrower is waiting" but it's actually a lie. They are just desperate to get the loan signed so they can get commission. I have actually had a borrower tell me NOT TO COME and the loan officer will call five minutes later and demand that I go because the BO is waiting on me. Well - I've finally figured out that loan officers think if we show up, the borrower will feel pressured to sign.

Since this is a new company to you, you have no idea if you will be paid for your time or edocs if the borrower is not home. Furthermore, if you are a single lady (as I am) it's not smart to go to a person's home until you have pre-screened them on the phone. I have a healthy skepticism of companies that call last-minute as this company did to you. Last-minute signings are usually pretty flakey.
And, now that the borrower has contacted you, I would still wait until speaking with someone at the SS or title company to verify the documents are not date-sensitive. Go ahead and call the borrower to touch base, but say that you must verify with the company that the docs are still okay to sign. It's waited this long, another day won't hurt.
This is how I would handle it; other signing agents may differ.
