Did you know that if you are Notarizing a DPOA and the signer is in a Skilled Nursing Facility in addition to the Notarization the Patient Ombudsman shall make a declaration that he or she is serving as a witness. Refer to probate code 4701 (e).

I looked that up and that specifically references anatomical gifts. (e) Make anatomical gifts, authorize an autopsy, and direct disposition of remains.

No information is given regarding the declaration, such as outline, content or if the signer (ombudsman) should be sworn by the Notary.

So - the very same probate code discusses the fact that an Ombudsman "shall" make a declaration.

In addition that very same code references anatomical gifts.

And you are making a leap that the two are joined together?

Joe, why don't you just go to law school and fulfill that need you seem to have.

I don't see how your post enables notaries to do their job better. Do enlighten me.

So that is why I always have to go thru the Omsbudsman at the hospital near me, they want to know what type of document it is. I knew from experience when my father-in-law was in the hospital in Santa Monica they also had him go thru an omsbudsman to notarize anything.
