Not sure if anyone will help me here....
I did a signing for an Abstract Company on Monday and the Manager called me today to tell me the loan did not close because I did not sign the bottom of the Hud.... I looked on a copy I had for my closing tonight and it states that the signature represents that the papers "I" prepared are true and correct... I did not prepare the papers so why would I sign this??? I have never signed it and no one has ever called me and asked me why I didn't.
The Manager said that in the 22 years she has been doing loans the Notary always signs this... Is this true?

No, you don't sign it. You are not responsible for it. Notaries only sign verification of identification documents.

Re: Not sure if anyone will help me here....exactly...YOU
did not prepare the document....YOU only "possibly" downloaded the documents....or just received the document, and then 'witnessed' the signature. IMHO...they are blowing smoke up your kilts and they don't know what they are talking aboot
"Doc"

Thank you!! That is exactly what I told the Manager! I wonder who she was using before me and why they would put their self in that position....
Thank you again.

"The Manager" is either an idiot or has been living on a different planet for the past 22 years. The settlement agent prepares the HUD and signs it - and that ain't you. How could you possibly know if the numbers are correct?
Never sign anything that identifies you as "closing agent" or "settlement agent" - that is not your function. The only exception would be a certification of ID; in those cases, I just strike the "agent" stuff and write in "Notary Public".

The title "Notary Public" should only be used in conjunction with an official notarial act. When signing a certification of ID form, I use the title "Signing Agent."

I've never signed it, never will... that's for the closing agent.
As I point out during signings, I'm not the CLOSING AGENT I'm the SIGNING AGENT. I then ask the borrowers if they know the difference. The punch line to that question "I won't give you any money." Usually gets a good laugh and helps them understand I am only a witness.

Sounds like they are trying to stall in paying you. After 11 years of doing closings full time, I have never had anyone say such a thing and I don't sign the HUD.
