I have been had! I did a signing last October. Yesterday, I was contacted by the sherrif Department and the borrower says that he didn't sign the docs. I know i did my job. I had to produce my journal so they could get the thumbprint. I am also a real estate sales person, so I ordered a prop profile. The poor man has lost his home to forclosure. I do not know what my responsibility is. The driver's license matched. Does anyone have similar experiences?

When people are going under for the 3rd time, they will grasp at anything that might save them and many would throw their mother to the wolves. Sounds like you're covered with the ID & thumbprint, tho'. You'll lose some sleep, but I think you'll be OK on this.

People are evil.

Notaries, in general, are people of integrity. We are not suposed to back date, use proper ID and witnesesses, etc. I KNOW I am never to give advice or my opinion. I know it is a CRIME. So I tell the borrowers: I have to be very careful what I say, because it is a CRIME for me to give you any advice or opinions, and I will not give you any advice or opinions. I can show you the FACTS of the loan, but that's it.

So one borrower, reading everything carefully, questioning everthing, calling his processor over every little thing, etc. and I finally got the loan signed in 2 hours. A few days later, the SS service calls me and says the borrower said that I told him it was a bad loan and not to sign it. I KNOW I would NEVER do that. I was so scared, becuase it was my word against his. And then I thought, "If I told him not to sign it, then why did he sign it?" I was petrified. He is playing with my LIFE because he is unhappy with his loan. I agreed to go back out FOR FREE and resign a new loan if that would make him happy so he would stop accusing me. What an evil, evil man. (And he was upset that I didn't speak Spanish, even though he spoke English just fine.)

Florida does not require a journal. I always use a journal and get the print of the thumb. That is the only thing that I would have as proof. There are so many borrowers that say "We never had to do that before!". It just amazed me. What we do is so important . There is a ALOT of money involved. But everyone has their own way of doing things. Its just one of the thing that I do to CMA.

I use a journal, but in Florida we are not authorized to take prints, so I do not take prints.

What do you do if the signer refuses to let you take their thumbprint for your journal?

I have not had anyone refuse yet but if they did then oh well. No one has ever had an issue with it.

I have had signers refuse to even sign my journal - citing privacy issues. Not all signers are accomodating as I have found out over the last 7 years.

What are you worried about? You didnt do anything wrong,

from what you describe. I always get a thumbprint, have never been turned down. If someone refused, I think I would have a problem with that. The thumbprint could be our protection, that and their ID and signature.
