A question about FHA, Reverse Mtg. and non-payment

I unfortunately did a signing for TS National Closing Solutions. As you've already guessed, I haven't been paid after repeated attempts via e-mail, phone, regular mail all with the same result . . . empty promised or no response at all.

This was was an FHA reverse mortgage and my question is, has anyone ever contacted the FHA regarding non payment for a RM?

I think this is my next move, unless someone out there has any other suggestions.

(I've already tried to contact the VP that was listed on earlier posts)

With TitleStream, call your loan officer and tell them

what's going on. I have a friend in WF and the more I read about this garbage, the more I feel inclined to let them and RM of Tx, etc. know how they are not paying their notaries in a timely manner.

When did you do these signings? I did two for them back in September (9/18 and 9/29) and was paid 11/30/06 - had to prod them to remind them and I kept hounding the person who hired me but finally got paid.

Sadly, this is a business-to-business problem. I don't see how HUD or FHA is concerned unless the consumer has an issue. I feel your pain but suspect your remedy is similar to any bad pay account.

I compeleted two signing for this company, one in March and one in April and so far no pay. I have called several times each time told the check will e sent in the next day or so. I was afraid there was something wrong here. I guess the next step is a demand letter.

Write the LO

and send TS a copy of the letter. If I were having trouble collecting from them I'd say something like (off the top of my head)...use at your own risk:


Dear Ms. Loan Officer,

This is a letter which I hoped not to write. However, I feel it is important to let you know that the title company which your lending institution is using for reverse mortgage closings has failed to pay me. In the online Notary community I frequently visit other notaries have reported the same experience.

I am hopeful you will contact them on my behalf and urge payment. I did the signing for [name of bwrs] on [date] and after several attempts at collecting for my work I have been unable to resolve this issue.

At this point, without assistance, I am left with no choice but to file a small claims petition in [county, state] and to provide facts through records, affidavits and/or subpoenaed witnesses to get my payment of [$amount] which I am entitled to, as well as to recoup costs of court and expenses related to the suit.

You can reach their office at [TS's number] and you should ask to speak to [Name of principal] or in the alternative to [name of principal] you can contact scheduler, [name of scheduler] and ask them to pay me for the appointment.

Your assistance in this matter will save all parties concerned from having to endure the collection procedure. It's quite possible that if I am owed then there are other notaries who are also owed and being ignored. Perhaps your phone call to TitleStream would urge them to relinguish the funds which are owed so that no further action is necessary.

Any assistance you can provide me in being properly compensated would be appreciated.

I am available to answer any questions you may have. Please feel free to contact me at [contact info] with questions or suggestions.

Failing payment from this company within 14 days I will be filing a small claims petition and may need your assistance through testimony or subpoenaed records to prove that I performed the signing and that funding occurred. Please feel free to share this letter with TitleStream if you think it will help.

I apologize for having to ask for your assistance, but my collection attempts to date have failed.

Laurie and Hank: Please let us know what works for you

As a veteran collector against TS (once), I'd just be interested to know what works and how quickly.

The good news is that so far, no one has reported that they never were paid. They're just really slow.
