Am I right about this?

I have been scheduled to do a 2nd location signing. First notary met with Mrs. Borrower, who is in Florida, and then fed-exed package to me. I received this morning and there were no dates filled in on Mrs. B's RTC. She had initialed at the bottom, but no dates. I immediately let the SS know so they could get this handled on their end today by having notary resign RTC's with Mrs. B. Since I am signing Mr. Borrower today, there would be no time lost since they can't disburse funds until after the latest 3 day RTC. This is the response I got from the SS:

>>For the 1st-location NRTC forms, please print the Opening date as 6/22/07 and Recission date as 6/26/07.



>>Your signer will use your signing date on the NRTCs.


What??!! Am I wrong here? I can't do this since I wasn't there, right?? This has never come up for me, but I am amazed that I was asked to do this. To me, this would be as bad as backdating a document. Thanks for your input.

I would have left hers blank, filled out my guys and let the first notary get the call about their lack of attention and skill.

The loan closed yesterday and they want you to backdate the transaction date, yes it is as bad as backdating the form. The TC COULD fax over the NRTC to the borrower and have them date it and provide you with a clean seperate one for Mr. Borrower but the funding wouldn't take place until next wk because he is signing today. They want it to fund this week.

I hated closing a mail-away at EOM when I worked for the bank. All sorts of problems came up because nobody planned ahead for the closing. Always issues!!!!

I do have seperate forms for Mr. Borrower (actually a non-borrowing spouse), who is here in Indiana. I am dating everything correctly (today!) on his forms. I just wanted to let the SS know so that the first notary could get it handled in Florida today, rather than wait until they got the package back to see the first notary had messed up.

Please go back and reread my first post....

My question was about the signing service asking me to fill in the dates for Mrs. B's RTC, who is in Florida. The first notary messed this up and I don't think I should do this...thanks

Update....

I emailed the SS and told them I could not do this...this is the response I got:

>>You’re not making any changes to the documents as clearly the customers initialed at the bottom of the form and printed the signing date. The Opening and Recission dates coincide with the signing date. If the dates were filled in incorrectly, then that would be a different situation whereas the customer would be required to line through, correct, and initial.

If the dates are not filled in correctly and must be redone, recission will have to be re-offered. Please instruct your customer to print the Opening date as 6/22/07 and Recission date as 6/26/07 on the 1st-location’s RTC form.


Do you agree with this QC Manager?

NOPE !!! You insert the dates that you witnessed. The rescission period starts when the 2nd spouse signs. I would NOT fill in dates for sigs that you did not witness. The SS has nothing to lose if you made a mistake - you do !!

First notaries mess up isnt your fix up. If the signing service wants to instruct the borrower to do this, that is a different story. Then your hands are clean from it. I personally would not touch these RTC's that they want you to date.
Why they are not calling the first notary to fix this is my question? And is the RTC form that requires borrowers initials next to the transaction date and RTC Date?

How is any of this going to help the situation? Seems to me the main problem if that Mrs. B didn't get copies of the RTC with dates filled in.
