I did a signing, on 5/06/07 for them but on 5/08/07 the borrower calls to tell me that they are cancelling because they are getting the same loan but the payments would be $50 less a month and wanted my to do the next signing for them. The new escrow company calls me to make sure I'm not related and offers me the signing.

CVD was supposed to be pay me a $20. fee for picking up the docs from another notary, which I did.

I was never told that they pay 30 days after the signing but they insist that they did, (I've been sending invoices before the 30 days).

On 6/05/07 I sent Dave from CVD a message saying that I was contacting the lender. Dave calls me early on 6/06/07 to tell me that I was told that they pay on 30 days which happened to be that day. He also tells me that they sent me a message in regards to the TIL, supposedly I missed. He told me that they had to send another notary out to fix my mistakes. I told him I never received any such message. Anyhow, he told me that he was only paying me $50 because of the error and not paying the $20 travel fee for picking up the docs from the other notary. He said he was mailing out a check for $50 that day, but as of today 6/9/07, I have not received any checks.

I know for a fact that there were no errors, the escrow company highlights everything, notes initial or sign here. I double checked everything before I left the signing, then again at home. The escrow called me when they recieved the package and thanked me, did not mention any errors.

On 6/06/07 after speaking with Dave, I emailed the escrow officer to double check the status of the loan and if infact I missed something. He told me it was cancelled and offered me another signing.

The only reason I did the signing was because I was gauranteed payment. I am going to start asking for partial payment prior to signings.

What would you all done in this case?

If you insist on partial payment before the signing, ...

... you're never going to do any signings.

Full payment within 30 days would be nice. Not to be expected of every company, but nice. Full payment should be expected of every company. Period. There are lots of companies that claim the NSA did not jump through the proper hoops and the fees are being reduced. (Do a search for "SOX".)

When someone claims that you've missed sealing a doc or having the borrower use their middle initial or ..., insist on getting a fax of the doc. If there really is a mistake, step up and fix it for free. If the claimant cannot prove the mistake, demand full payment. If payment is denied, report the company by name here.
