Im in SHOCK!!!!

I had an appointment with the borrower tomorrow at 9:00 am. I got a call from the loan rep, and he had the nerve to tell me that I had to back date the docs, because the lender to him the they will expired after recission day. And I refused, I told him he was asking for something that was illegal. So he said "Iwill have to find a notary that will do that".
Well I hate to say this but, he found that Notary. And after 30 minutes, she called to let me know she was on her way to pick up the docs. Im still amazed!!! Shame on her. (UGLY NOTARY, BAD GIRL!!!!). Let's do be like her.

I hope you will remind her of the fact that FRAUD is a FELONY in every state when she picks up the docs. You could also tell her that you can look up the recorded mortgage and file a complaint with her county bar and/or SOS. Ask her if committing fraud and violating her oath is worth losing her commission and a lot of potential liability.

The only way to weed out these no-conscience notaries is to turn them in. I'd mention it to the LO as well.

It goes to show that there are those who do not appreciate the position they hold as a notary. Why go through getting licensed just to take a chance to lose it? Once it's gone you may not get it back.

allow someone to pickup docs from me.....they can print them at no charge/pay TOO!! Nor would I forward the email........ they need to start from scratch.

I have reported such notaries & lenders. It is illegal for both parties to participate in this form of fraud. I would report both instead of placing your outrage for this act in a forum. If you did note this for feedback; good for you. Shaming someone is worthless; turn them in. Once these predatory & fraudulent operators get busted the industry will begin to change. Good luck!

I agree, don't give him/her the docs.
You might want to mention they can also possibly go to jail!

I would also report that Notary to their SOS. There is no excuse and she/him is taking away your business for these wrongful acts.

Providing they haven't been picked up yet, insist that the notary sign and DATE/TIME a receipt for the docs. Then tell her you have a receipt for when she picked up the docs. Tell her you know that she is planning to backdate and you WILL pull the filed Mortgage and report her to the SOS. You have the receipt for the docs to prove it.

That should stop her in her tracks. Oh, and follow through.

Don't give her the docs. You just wasted money printed out the docs.
As far as turning someone in, I have turned in probably 6 notaries in my area and proving it
is another story. LFC in CA is using non-licensed notaries here and I turned them in and the MIA said that I have to prove that an attorney was not present when the notary did the closing and did not have a title producers license. Trying to prove that is almost null.

But this notary that is picking up the docs a day late, and having her sign something, may be the bullet she needs in this gun.

Are you saying that MD will NOT require proof nor has any way of checking that the notary in question has a TPL?

Me and several friends of mine, that are licensed title producers in Maryland, are so ticked off.
Several title companies are using non-licensed notaries in Maryland. I contacted the Maryland Insurance Admin. and gave them names and even links to their profiles on NotRot.
They called me and asked me what proof I had that they were doing the closings unlicensed and I faxed them copies of the deeds of trusts that they notarized, along with the names of the title companies that were using them.

A rep from the MIA called me and told me that that was not really proof, we had to show them that the title company actually hired them and they went and did the closing and did not do it in front of an attorney that is licensed to practice law. Now, how in the world can I prove that? The law is good but the MIA does not have enough staff to babysit the notaries.

I told her (the rep at the MIA, while I was steaming mad) that it was a waste of money if they were not going to enforce the law and I should just let my license expire and do closings anyway (I would never do that, been licensed for years). She then threatened to file charges against me if I did that (WHAT!). I was so upset.

I chalk it up as a waste of my money to be licensed in Maryland but I do it because IT IS THE LAW. The notaries around here (that are not licensed) have no conscience and I will keep turning them in, even if I can't prove it. We have actually called notaries here that we know are not licensed and pretended to be a title company and actually have had conversations with them so I know that they are not licensed title producers in Maryland and they are doing email doc closings.

It really makes me sick.

Have you thought about

contacting the attorney general in MD? Seems they would be interested is people that are defying the law. Depending on how much you want to pursue this, but I would think that affidavits from the borrowers stating that NO attorney was present might carry some weight. Just some thoughts.

As you know Loretta, I am on a border county. I get calls all the time to go into MD. I tell them I cannot cross state lines and I then give them the number of a MD title producer. I can't count the number of times I'm told they want 'just a notary, no need for all that'. I tell them to call him as he does exactly what I do but he seldom receives the calls.

I recently picked up a new MD title company client and did quite a few loans for them. They started asking me to go into northern MD. I told them I couldn't cross the line. Haven't heard from them in about 2 months since I started turning away the MD work - guess they found someone to work both sides of the line.

I see quite a few PA notaries advertise that they cover certain MD counties - I always wonder if they're even commissioned in both states.

are not licensed, where do they get their stamp? Is it not a law that all notarizations be stamped and the NP name signed and printed as well as the date of EXPIRATION be affixed to the documents?

They are a Notary Public and have a stamp for that but the Title Producers License is not a stamp. It is a certificate that one gets for completed classes and all MD fees paid and bond purchased. The only way one would know if someone is licensed is looking thier name up on the MIA website. I also have a certificate here at the office and one wallet size one.

FASS has been using unlicensed notaries the whole time. I know of 3 different people in my area running themselves all over the place for those big $50 fees. They can have them. FASS is too cheap to pay what title producers need to charge.
