Now I've Seen Everything

In over 7 years in this biz I have seen some of the weirdest closing instructions relating to a signing I've accepted. Tonight I start downloading my package for a 10:30 AM Saturday signing and while printing I read one line that stood out. It read "...at the closing please have Mr. ?%$# sign the mortgage and a notice of right to cancel. If he is deceased please pick up a copy of his death certificate..."

OK, now I've seen it all!!!

ROFLMAO... but...

at least they didn't include an Affidavit for the deceased to sign stating that s/he was... well. deceased.

lol! however, I have actually run into this - docs included wife's name on everything, but when I contacted Bo, was advised she had died five years ago. Title co advised me to get copy of death cert, have him sign in his own capacity and everything would be fine.

Iwonder, what if the deceased wife left a will and it was probated and in the will her interest in the property was left to someone other than husband.... or..... what are laws of descent in Ohio?

Don't know for sure. If it was probated, then I believe a new deed reflecting the new owner of her portion of the property would have gone on record. I'm guessing it was a husband/wife deed with right to survivorship, and a no-administration estate, with no new deed having been drawn up. But that's all supposition on my part. I got paid. Mortgage got filed.

If it comes out of the computer, it MUST be ok. I have .....

seen one of parties name with the word "deceased" printed
on the dox, and , of course, strict instuctions, that they
"must sign names exactly as typed"
Also once had bwrs John and Suzi Jones.
His name was printed as John Jones and her's was printed
all over dox as Andsuzi Jones. Same strict instructions of course.
Had one last week, where one of the bwrs name was misspelled
on all dox. We did a resign and her name was only misspelled on
only half of the dox, including different spelling within the same doc.
Also have seen John Smith and Joan Smythe (not her maiden name, she
took his name when they married, but whoever inputted info decided she
spelled it differently.
Quality control??? We don't need no stinkin' quality control.

Signed incorrectly before & recorded

Had one this week where Mr's name on docs included incorrect middle initial. Reason? A previous loan had been signed incorrectly, recorded & no changes were ever made to correct. Strict rules to not allow borrower's to make any changes at all. Call to atty -- I can't notarize name as typed...ok to change deed only, but have him sign all with correct m.i. I had him sign everything with correct m.i. so I could notarize correct name.

I've also seen wife with maiden-married & last name of husband typed as (wife)maiden-married. I always get a kick out of that one. Usually joke on AKA statement that husband should list his maiden name...gets a chuckle out of bwrs.
