Question about Acknowledgement Form
Hi All. On Friday, 6/22 I did a closing which was notarized in three different states. On the acknowledgement page of the quit claim deed (that I should be notarizing) he placed his seal. Do I just strike it and initial or does the acknowledgement page need to go back to the previous notary?

You have three different signers in three different states, right? Let's call them Tom, Dick, and Harry. The first notary takes Tom's acknowledgement, and completes a certificate that names only Tom. The second notary takes Dick's acknowledgement and fills out a 2nd certificate that names only Dick. The third notary takes Harry's acknowledgement and fills out a 3rd certificate that names only Harry.

I would line through it, initial, reference the new loose certificate and then complete and attach it (the new loose certificate).
Also, the previous notary still needs to correctly notarize his certificate (Since he incorrectly sealed your Acknowledgment certificate in error).
I would also contact the title/signing company and let them know of the mishap.

It's hard to picture just what this QCD looks like. If there are three acknowledgement certificates, and each notary has signed in the right place, but one of the notaries has placed his seal closer to your acknowledgement certificate rather than close to his own, it might be OK. I think there is an understanding that it can be hard to fit seals, and sometimes it is necessary to put them wherever they fit.

No, no, NO! Don't do anyything with the first ack!
It is not your responsibility to make any marks whatsoever on the QCD. You could cause severe problems by doing so. Just don't do it.
You should attach a loose acknoledgement, acknowledging only the signer who appeared before you.
By all means, contact the firm that is paying you and make them aware of the circumstances.

If the only problem is a seal on a blank ack, I'd just ignore it and complete it and place my own seal. In Texas, an extra seal from another notary would not be a problem IMHO.

Who ever drafted the QCD should have taken into account that the three signers were not going to be at the same place at the same time and added a seperate acknowledgemt for each signer. This would have eliminated the problem and any recording issues.
We see QCDs a lot up here and for what they charge to draft one, it should be clean and clear-cut. Attach your acknowledgemt to cover your signer.
