Hello everyone!
I received this e-mail a few minutes ago and I was wondering if any of you are aware of this circulating. I have spoken to several attorneys that I currently work with and they have not been notified of any new "rules".

"NNA is telling us that witness signing agents can no longer close in MA, even under the supervision of an attorney; that the attorney must attend and complete the closing and the concomitant affidavit(s).

Hi Nancy,
My attorney and I haven't heard anything about that new rule. I'm not sure how they could just make up a new rule like that without approval from the Governor. Executive Order 455 (04-04) is the law, and until it is changed, I'm not going to worry about what the NNA says.

Thanks for your feedback. I too checked around and made some phone calls and no one I spoke to was aware of any changes either. I just wanted to bounce things off the rest of the MA notaries.

I just called the Governor's Legal Counsel. They stated that no new law has been passed. Therefore, Executive Order 455 (04-04) is still the prevailing law for MA notaries.

I ike that statement! Thank you for your reply and validation. As I also said to Korey, the people I have been working with also had not heard of any new ammendments. However, I will say-that I have lost a major player in my notary referrals because the lender "Countrywide" will no longer allow notaries for anything!!! They are insisting that an attorney be present for refi's etc! This is killing my business! I think perhaps, what the NNA has mistakenly said has rippled over to a few places and is drying things up here in Massachusetts.
I think we as Ma notaries should perhaps unite!

Must only be in the Coomonwealth
I have closed 3 countrywide loans today and have 3 more scheduled this PM, all without the use of a lawyer.

They pretty much have halted all the countrywide loans here in MA for notaries. AND, my son is a Countrywide loan officer!! It really sucks.

They pretty much have halted all the countrywide loans here in MA for notaries. AND, my son is a Countrywide loan officer!! I work under the attorneys that handle all the countrywide closings in Ma and we can't even work under an attorney. It really sucks.

Reality check
Who did the email come from, and have you confirmed that the NNA is actually saying this?
I know they get things wrong (their recent commentary about a bill in the NY legislature was way off base), but I haven't seen anything from them recently about a change in MA statutes.
A specific citation identifying the NNA as the source of this would be helpful...

What we have so far is some hearsay about the NNA, Massachusetts and Countrywide. If, indeed, CW is no longer allowing for closings to be done under atty supervision there - and on that all we have is rumor - it might not have zip to to with any government action/change to Exec. Order. There's more than one way to change the protocol of a huge national company - sue them. It might well be that CW is going through litigation that has caused their legal dept to reconsider the acceptability of supervised closings in certain states, perhaps another 'atty closing' state. I say MIGHT because I have no clue. It might even be a determination of risk made by whomever buys their loans, or it might have something to do with their licensing in that state - could be a lot of different things, or it could be NOTHING but rumor and completely unfounded.

Exactly. I'm no fan, but that's a pretty big blob of misinformation to be attributed to them if it isn't so.
