I would like someone to tell me exactly which docs need to be signed by a non-borrowing spouse. Does this vary by state? I am in Washigton. I have done research but cannot locate an exact answer. I want to print it our and carry it with me in my briefcase. Many thanks.

Generally, it is mortgage and riders, right to cancel, and truth in lending. Check for the list like Sylvia says in the tc instructions. If no list in instructions, those three usually suffice.

and I believe that I found my answer. My take on it is: if I know that there is a non-borrowing spouse, I should ask title or SS exactly which doc's they want signed. I already know some of them, but I believe that more docs may depend on the specific state, or title co.

Feel free to correct me. I appreciate learning as much as I can.

You are correct. Always check with the title company what docs they want the non-borrowing spouse to sign - if the docs aren't preprinted with the names under the signature line.

I usually check the message boards around 11pm and then watch CSI Miami at midnight before going to sleep. Just decided to do another check on the boards while the commercials were onSmile

Only state specific issue is IF a NBS need to sign anything

If the NBS has an interest in the prooerty as detemined by applicabel
state law , then they must consent to the transaction. as a lien is
being place on the property in which they have an interest
If necessary for a NBS to sign then lender decides which dox are necessary to
be signed by NBS.
As a minimun : NBS signs MTG/DOT, RTC and TIL.
Purpose is to have NBS permit their
interest in the propety to be subject to the lien of the mtg.
As one having an interst in the property, they , along with ,
primary bwr, have a right to cancel.
If you look at a right to cancel form the starting date is the date
that each party with an interst in teh prooperty recieves a copy of
the TIL and two copies of the right tocancel.
The sig of the bwr and NBS constiutes a receipt stating that they
recieved the requisit copies on that date.
Some lenders also want NBS to sign E & O
Some title cos want some of the junk dox signed also
