Section 5.2 of Notary Rotary practice exam presented

a couple of interesting examples using a subscribing witness and a credible witness, and I'm not feeling comfortable. Just looking for a better perspective.

The two are not the same.

Checkout the 2006 Notary handbook:

http://www.ss.ca.gov/business/notary/notary_hdbk.pdf

I have not had the occasion to use a subscribing witness.
And it would be under VERY extraordinary circumstances for me to do so.

Don't know why the handbook opened to the wrong page.
Should be on page 14: http://www.ss.ca.gov/business/notary/notary_hdbk.pdf

Hopefully, it will show correctly this time.

Re: Subscribing/Credible Witness - Any CA experts available?

A Subscribing witness cannot be use to notarize a recordable document. For example a deed of trust.

For example a loan package was sent to the borrower who signed every page including the notarized pages. Then he asked a friend, could you take this signed package of documents to your friend Katrina the notary and have her notarize it for me. So the friend carries the document (s) to you Katrina and you say (Friend of Loan Package signer) do you swear that the Loan package signer personally signed all those papers? and the friend says YES! So the friend of yours is the subscribing witness. Except unless that friend is carrying the loan package signers right thumb in her pocket you cant get a thumbprint in your journal so the deed goes un notarized.
