US Title in Cary NC - Beware!

Let me preface this by saying this ONLY applies to the US Title in Cary NC - not the other companies with the same name in other states. US Title calls and books me for a job. Then the confirmation comes from US Settlement Corp. When the docs come, I discover that they are basically acting as a SS for Solutions Title in TX. US Settlement is listed on the HUD as the recipient of the Notary Fee, so they are paid upon funding of the loan, and they made a tidy profit off me.

Fast forward 60+ days. I am still waiting for payment. I'm not alone - there are many others in my state that are owed payment, some well beyond the 60 day mark. We've been calling, faxing, and e-mailing. We are promised payment, but it doesn't come. The latest story one of us has been told is that a large check is coming this week from Solutions Title, and then US Title will be paying us. Wait a minute, what happened to the funds US Title received for MY deals? I am now going to be paid off the deals of other notaries that did more recent jobs???

Many of us have been in contact with Solutions Title. They are aware of the situation. Just beware if you take a job for US Title in Cary, NC, you may be waiting a while for your payment.

Admitting ignorance up front, I've been wondering ...

Where the contracting party for our services is a TC or a SS either wholly owned by a TC, can we seek redress from the regulatory authority over the TC? I know in some states, the regulatory authority is the state's Department of Insurance, some of which do have a complaint process. Might this be an option in some states, but not in others?

Back when I was trying to collect an overdue invoice from a particular SS which included in its name the name of the TC that owned it, after a bit of research first, I advised that contacting the DOI was one of the remedies I was considering. My check literally went out the same day.

I've wanted to ask this question for some time, but suspect it to be naive and uninformed. I ask for your patience if you're willing to educate me on this point.

Barb, are you saying that you contacted the Department of Insurance to settle a problem with a signing service?

No, I told a TC-owned SS I was considering it because it

appeared to be an option to me. I can't say that that caused the SS to call me back within a couple of hours, cut my check and mail it out that day, but apparently, it didn't hurt my cause any.

The state was Texas.

She said the SS was owned by the TC. The TC is regulated by the DOI.
To often the title work is done online. Who regulates that out of state TC when "doing business" in state. You would have to go to the TC's state DOI I would think.
For SS's it would be the enity in their state that registers Coporations and LLc's IF they are incorporated or a LLC. That is a tremendous tax and liability benefit to be Inc or LLC.
Which brings me to taxes. Are they reporting your fee as paid to the IRS?

Yes, my threat was as to the TX DOI

This was a reverse mortgage, and I threatened to contact certain other authorities, as well, but the DOI appeared at the time to be the most direct route, based on my preliminary research. I didn't have to follow through, so I don't know if it would have been a legitimate source of help or not.

I also threatened to round up other SAs who had complained about the same SS to join me to demonstrate I wasn't the only one experiencing this problem.

US Title is the title company owned by US Settlements. They aren't acting as an SS, they are one and the same.

They also have excuses for everything.
