Question on Refi document
I have an Owners Affidavit and a Survey Affidavit that were in my loan docs. There are some blank lines stating "That this affidavit is being made in order to induce ________" and ..."said parties rely on the statements made gy the affiants herein are aware that _______ is insuring the title.." and the Survey Affidavit states ...affiants, each of them, are making and giving this affidavit for the purpose of the completion and consummation of a certain mortgage of the referenced property to ______ and to induce (title company name). I don't know what to fill in these blanks. Any help would be greatly appreciated. I need to go back to the borrower tonight and have them sign this paper so I need help. Can't get a hold of the doc people. Thanks in Advance. Sandi

Sandi, 1st rule to remember is you were hired to present loan doc's to the borrower's and to witness and notarize signatures only. Do not fill in any blanks! These are basic Affidavits in a Refi pkt and you should only have borrower's sign & you witness their signature. That's it! Just remember your primary responsibility as a notary & you will be fine.

Arizona does not recognize daylight savings time, so 6 months of the year they are on the same time as California, the other 6 months they are on mountain time.

Not sure about AZ, but here, and in many other states, a notary cannot notarize a signature on a document that is incomplete (containing blanks). Further, how is a person suppose to swear to (or affirm) the contents of a document when there are blank spaces in the document?
Granted, it is not the notary's position to write the information in the blank spaces, the signer should do that, but the notary can direct the signer to complete the blank spaces. If you and/or the signer do not know what goes in a space, call the title company.

Sorry folks, just got up & realized Yes, you're right Paul on instructions to Sandi. Just wanted to advise her she was not to fill in the blanks on doc's, the borrower or Co does that. My error in not explaining further re: blanks. Was way past my bedtime & then I saw the diff in time. Sorry

you can't notarize the signatures on......
a doc with blank lines as it is an incomplete document.....i just draw lines thru the blank spaces [ as wi says to do] and notarize.....not your job to fill them in.....

Sandra, if there are blanks in these documents and they need to be notarized, point this out to the borrower. If they know the information, have them fill it in. If they do not, have them line through. You cannot notarize a document with blanks.

If there is a notarial certificate on the document, you need to notarize it.
Your choices are:
1. Have the borrower fill in the blanks and sign, then you notarize.
2. Have the borrower line through or indicate "N/A" in the blanks and sign, then you notarize.
Although it would have been better if the TC had filled in the missing information, you don't want to have to make another trip because you failed to notarize the document.

I have had them write "unknown" in the blank or N/A if appliciable.
