DISAGREE: Diane Cipa's view - VOTE ON IT!!!!

Since Diane Cipa and friends have moved from her blog to here, I now see what could be considered, a conquer and divide situation starting! Why not take a vote on the issue. I will start.

DISAGREE – I disagree with Diane’s view because:

We are just now getting recognition from the mortgage industry, for the good or bad, the new Uniform Closing Instructions as it is, is a start and one I can live with for now. There is a time and place for everything, and now is not the time to DEMAND anything from an ailing industry!!!

Diane Cipa is NOT our advocate! She has stated many times in her blog that our profession should not exist, and that she is losing money because of us, since we are the reason out of state title companies can take away her income!!!

I believe that if she succeeds in her quest, we will see one of two possible outcomes:

1: We will see more attorney only states because of the conflict between the industry and our states, on our duties as a notary public verses our duties as a “Signing Agent”.

Or

2: Our profession will become so convoluted that you will not recognize it, nor would you want to be part of it!!

Please do not argue and make this personal!! To make this a countable vote, only respond one time under this heading as AGREE or DISAGREE and why you feel that way.

Disagree...

Wouldn't I love a license! However...at this time...I feel licensing will provide the first of what Teresa stated. "We will see more attorney only states ...." but for reasons I have stated before.

Perhaps in another thread Diane can ease my mind on why this won't happen in Texas, AK, MI, PA, and other states where this concern has been expressed recently on this forum.

OK Diane, I have never responded to your post before but now I MUST.

I got a PM from a fellow notary service that says that you say that Signing Services are in violation of RESPA because of them not doing anything to basically earn the monies, or that the Title Co. charges more than what they pay the Signing Service and pockets the rest of the monies.

1) I would say that maybe the Title Co is in violation of RESPA not the Signing Service, because as a Signing Service I can only charge what the Title Co will let me charge them, if they get more out of the borrower then thats on them.

2) I do more than just sit back and assign NSAs to do closing Diane.
I load documents on my system for the notaries to pick up from my web site.
I call 10 NSAs to find one that can do the closing.
I have overhead just like you do Diane.
If an NSA makes a mistake I need to follow up on that, and answer to my customer as to why the NSA made that mistake.
TRUST me Diane there is more to a Signing Service than meets the eye.
I am sure that you know that though because you almost run a Signing Service right out of your office there in your Title Co.

The only difference is that you pay your NSA an hourly wage if I remember correctly Diane. Now isn't nice that you have that luxury to do that and I don't.

And as far as the part about getting evryone licensed to do closing, I DISAGREE with that all together. There is already enough regulations in this industry.

Hi, Anthony. My closers are paid $150 per closing. They have benefits and a company car.

Damn I'll close my shop and work for you@ those rates..lol

Honestly not many companies could pay notaries that rate plus a car and still keep the doors open with this current market.

The last 40 days have turned around for me, but the slow time is not far off plus I need to pay back my lines of credit that helped me out during the slow months.

Why do you do that? Why not give them the link and allow them to print from there. Seems to be a wasted step - and every step encourages one more instance of some type error or problem.

These endless Diane Cipa based discussions are turning this board from an entertaining place to visit to a boring, stuffy, neverending stream of blah blah blah.

I've read just barely enough to know what they're all droning about in the first place and I think when all is said and done the fallout is going to be like the background check panic of a year ago and virtually nothing in the industry will change.

Hi, Tess: I'll just one of many ears listening in on the phone meeting. You can join in, too. The information about the meeting was posted here a day or two ago.

The MBA is sponsoring the phone meeting so people all over the country can hear discussion about the proposed Uniform Closing Instructions. So far, we have only been able to read the words. Hearing them discuss what's written will help us all to get a better idea of where they intend to move the process.

My plans are to follow that phone call with some thinking about what they really want in the end and how title agents and independent closers fit into that scenario. Whatever conclusions I reach will go into comments on my blog and to the trade associations, et al.

I've been in this business for over 30 years and there are times when change is inevitable. This is one of them. There is a need for greater control over the closing process. Mortgage lenders have suffered extraordinary losses due to loose procedures. They have a duty to step up to the plate and I expect that the procedural changes we see coming along with the new UCI will be far reaching.

Yes, Susan, my viewpoint has been evolving. Open discussion and free exchange of ideas and opinions is a beautiful thing.

There is not a single person reading this board who will not have their business plan changed one way or another by the UCI. It's exciting and scary all at the same time.

Diane,

Change, is not the problem here. It’s the “kind” of change that may be forced on our profession that is the problem.

I will be listening on Monday, already signed up. I also may have a proposal that could help the situation, one I am still formulating, but feel would be acceptable to everyone including MBA.
